The photo above, which I titled "I surrender", seemed apropos for this post.

I would like to preface what follows with this caveat: This post is more about emotion than it is copyright law, of which I am not an expert nor even remotely qualified to comment on. This is merely my observations as a content creator on Flickr.
<br><br>
When I opened my Flickr account I used a Creative Commons Attribution only license. This came to an abrupt end after a few weeks when I found one of my photos being used in a for-profit blog with the attribution copy in 4pt type in the footer of the post. Did the user of my photo meet the terms of the license? Possibly, but to minimize my contribution to his post wasn't cool. I felt ripped off.

At this point I switched over to a Creative Commons Attribution-NonCommercial-NoDerivs license that I hoped would alleviate the commercial peeps from using my images without permission. I thought it might also motivate others to give proper attribution.
<br><br>
It did . . . once. This year I was approached by a company that wanted to use the photo as part of their mapping software. It felt great to have someone ask to use a photo, even if it was for free. Their agreement allows me to retain all of my creative and publishing rights. Nice.
<br><br>
So, I have been thinking about my experiences over the last year with my Flickr account. There have been both positive and negative experiences but mostly positive. However, for some reason the negative ones have won out. I recently switched my photo licenses back to traditional copyright with all rights reserved. 
<br><br>
I look at this move as putting up a fence or at least a no trespassing sign. If someone asks for permission to use one of my photos I will almost always give them permission to use it. I am flattered every time that I see someone linking, posting or asking for permission to use a photo.
<br><br>
What are your thoughts? It all depends on what people are searching for.<br><br>Painfully obvious, right?<br><br>Well, not so much when someone searches at Google for <b>intitle:"chocolate" ext:rss</b>. The odds are astronomically high that even chocolate experts weren't even returned as results. <a href="http://turo.us/1sYrg">See for yourself</a>.<br><br>So what does this mean? It means that someone searched Google for a <b>RSS feed</b> (ext:rss) with the word <b>chocolate</b> in the title (intitle:"chocolate").<br><br>Yes, the search is more advanced than a keyword or phrase based search but that isn't my full point. The reason that it matters is that not only did this individual search for chocolate but also culture and abba. Not quite sure what it says about the person searching for those topics . . . <br><br>So for me, these three hits matter. They are three more than I would have normally received for those topics and a chance for me to get them to possibly subscribe to those feeds, subscribe to my podcast, click an ad (yes, I like money) or get my brand in front of them.<br><br>I am able to do this with keyword feeds that I create dynamically from posts that get the same SEO treatment that a normal webpage would get.<br><br>The other plus for this type of search is the fact that they return so few results and Croncast happens to be ranked #1 for most of them including searches like, say . . . "<a href="http://turo.us/1rJPE">CNN</a>" or "<a href="http://turo.us/6Fdni">Micorsoft</a>" or  "<a href="http://turo.us/0UAER">iTunes</a>".<br><br>I've had conversations with a friend, <a href="http://www.rklau.com/tins">Rick Klau</a>, about RSS feeds being indexed in Google search results. Most of those discussions focused on my saying that feeds should show up in search results and Rick saying that they shouldn't.<br><br>My stance is that some people, like myself, benefit from these results the same way that we benefit from a normal click through to our sites. I am able to do this by checking where the individual who clicked through is coming from and displaying a web page instead of the RSS with the exact same data that was in the feed. <br><br>But I don't stop there. I also make sure to let the user know how they got to the page and that they can now subscribe to that feed. It's a soft landing for what traditionally has been a hard look at XML or ugly feed displays in browsers. Which is where you will end up with 99.9 out of 100 feeds if you click through them when returned in a search.<br><br>What is Rick's position? If 99.9 are bad then they should be removed. For the time being I will agree that he is right. But that doesn't mean that this is the way it always has to be.<br><br>A couple of things could change this:<br><br>1) The uptake of RSS since IE7 and and FireFox now display their own XSLT to prettify the XML. Sort of like FeedBurner does.<br>2) Publishers add their own XSLT for their feeds<br>3) Publishers using blogs, most of which are dynamically generated, are written with code that can check for referers like Goolge, Live and Yahoo and redirect the user to a page that has the same content as the feed<br>4) My favorite. Loaded chocolate cake<br>
Who wants to do more cake?<br>
I am wired at this point<br>
I didn't have an iris left<br>
Just black eyes from open pupils<br>

			<description><![CDATA[Time to plug myself like I have no shame!<br><br>Thus, in the true spirit of being shameless, I will create this unabashed self-promoting bit of text to tell you about the Kris Smith that many of you don't know.<br><br>Planet earth had just escaped the Y2k bug so we bought our first computer since they didn't destroy the world they must be okay. So in early 2000 I taught myself how to use Wavelab to edit audio and later that same year I took my first programming class to learn HTML. The rest is history, as they say in the biz.<br><br>In the last seven years, I've accomplished more things in digital media and web development than I could have ever anticipated:<br><br>

1. Developed and coded the first version of Castlock a New Media and metrics platform<br>
2. Founded the world's first company dedicated to podcast production<br>
3. Worked with and produced for Fortune 500 companies<br>
4. Spoken at conferences and universities across the United States about RSS, New Media and podcasting<br>
5. Developed moderated media RSS feeds (mmRSS) for episodic and archived content delivery via RSS<br>
6. Gained a network of professional colleagues across the globe<br>
7. Interviewed celebrities and professional athletes<br>
8. Became certified in DVD authoring software used for major motion pictures<br><br>

It is being held the Thursday before the <a href="http://portablemediaexpo.com/" target="_blank" id="tico">Podcast and Portable Media Expo</a> begins, September 28, 2006.</p><p> I have the great fortune of being one of the instructors for this event. I will be presenting in a morning session on podcasting integration. The title of for my session is "Successful Web Design for Podcasting".</p><p>The goal of this session is to have attendees take away an understadning of the essential ingredients that go into a successful podcasting website. We'll discuss different types of podcasting websites, their ease of use or lack thereof, interactive elements, graphic treatments and campaign readiness.</p> Say what? Site design is often overlooked as many businesses begin the task of communicating with internal departments, external agencies and consultants after they have chosen to produce a podcast. The website is an afterthought, when it should be considered from the very beginning of the initiative.</p><p>I would recommend that if you are the individual chosen to become your company's resident expert in all things podcasting that you consider attending this event. I'll be speaking about my experience starting up and running a podcasting production company, <a href="http://www.palegroove.com" target="_blank" id="tico">Palegroove Studios</a>, and how other experienced podcasters can do the same through consulting.</p> <p>What? Tell people how to become your competition? Sort of.</p><p> Think about how many web designers and developers there are today. Now, imagine if there were only about 100 in the world that were considered 'experts' and could be trusted to get a job done professionally. Could they handle all of the work? There's plenty of available today for more than 1000 podcasting consultants.</p><p>To say the least, I am excited about this opportunity to share some of my ups and downs over the last 1 1/2 years. I am probably more willing to share my downs since there have been more of them, but each one an excellent teacher.</p><p>Last but not least, fellow Naperville geek drink compadre and friend, <a href="http://www.rklau.com/tins" target="_blank" id="tico">Rick Klau</a>, will be speaking also. He's got duty explaining and evangelizing RSS on the newbie front. 	<p>We talk about <a href="http://www.KEXP.org ">KEXP.org </a>radio from Washington, Mendel the Monk, "Value Village" sent in by Henry Hedberg, how Betsy would have gotten off the Mayflower solely on the fact that she would see a gay native on the shore who would know where the party is, Betsy says the west is an ash tray thanks to her trip to Phoenix.</p>
	<p>Betsy says she host photos, finally, for me to put up of the prizes but she hasn't given them to me yet, I try to get Betsy to ask me about something with animals that I may not know about (cause I am such an animal expert) by giving her time by telling a story about a $30 tip that I received as a table-side chef from burning the side of my head, she comes up with "what days are the tag days at Goodwill?".</p>
	<p>We also talk about naming kids thanks to Allegra, we start the outro and then I remind everyone that they can donate some money to support the show here at the website. Betsy says that even $1.99 will go far at Goodwill.</p>

	<p>Today's show short. I had to paint the upstairs baby room, well started on the bottom stripe. I recorded this on a break that I got from from warden Betsy. The warden thing is a joke . . . I am really enjoying the painting of the room. </p>
	<p>I talk about the new show that I am producing NCQTalk which will debut on February 21, The Invinvibles at <a href="http://www.theinvincibles.org">www.theinvincibles.org</a> and let you in on my secret reason for the short show . . .  blown interview on Sunday night with Nicole Simon from <a href="http://www.useful-sounds.de">www.useful-sounds.de</a>.</p>
	<p>Betsy will be back with me tomorrow and I am sure I will have some painting expertise to share. Oh yeah, I almost forgot I will have some pictures up here pretty soon so you can check out the work in progress.</p>
