In addition to new App Store software, National Public Radio and The Wall Street Journal also plan to create specific versions of their Web sites completely devoid of Adobe Flash for iPad users.

This week Peter Kafka with MediaMemo revealed that both NPR and the Journal will convert at least some portions of their Web site to load properly on the iPad. The custom-built sites will feature the same content and run concurrently with the traditional and iPhone/mobile-friendly versions of each Web site.

"Visitors to the newspaper's front page will see an iPad-specific, Flash-free page," Kafka said of the Journal's iPad Web site. "But those who click deeper into the site will eventually find pages that haven't been converted."

The news comes weeks after Virgin America revealed it dropped Flash content from its new Web site in order to allow users with iPhones to check in for flights.

But the Journal and NPR are both also creating App Store software specifically for the iPad, suggesting that content providers are taking a multi-pronged approach to Apple's forthcoming multimedia device. Kinsey Wilson, head of digital media for NPR, declined to give Kafka an advance look at the organization's forthcoming iPad application or Web site, but did provide a hint as to what the experience could be like.

"Wilson says that while iPhone apps are a 'very intentional experience' --you load the thing up and seek out specific content -- he thinks the iPad will be a 'lean back device,'" Kafka wrote. "That's traditionally the distinction multimedia types use to differentiate between a computer and a TV. Intriguing."

The exclusion of Adobe Flash from the iPad and subsequent comments attributed to Apple co-founder Steve Jobs, in which he allegedly called the Web standard a "CPU hog," have led to a considerable amount of debate over its merits and shortcomings.

Contributing to the conversation in January was Google, which added support for rival format HTML5 to the most popular video destination on the Internet, YouTube. The beta opt-in program is available only for browsers that support both HTML5 and H.264 video encoding. Apple, too, has placed its support behind HTML5.

As a long-time vegetarian (over a quarter-century), I find America's obsession with "more meat" competitions simultaneously amusing and repulsive. On my personal blog, I have routinely chronicled the "burger wars" between heartland restaurants trying to outdo each other by offering bigger and bigger burgers. As far as I know, the current high-water mark is the Beer Barrel Main Event Charity Burger, a 123 pound burger that includes 80 pounds of meat. See the photo. If you're one of those people who thinks a burger can never have too much meat, good luck working on that bad boy.

Today's post involves subway sandwiches instead of burgers, but it turns out that subway sandwich restaurants' competition over claims of having more meat is no less stiff. Quiznos kicked off the war in 2006 by launching a "double meat" line of sandwiches. Quiznos ran two TV ads comparing the meat in its sandwiches to Subway's and set up a website soliciting individuals to make and submit their own comparative digital video ads. Subway was not amused and ultimately filed a seventh amended complaint (!) over Quiznos' ad campaigns. (What a patient judge).

The parties hotly contested every aspect of the litigation, and Rebecca does a thorough recap of the lengthy ruling. I'm going to focus on the court's discussion of the crowdsourced video ads published on Quiznos' ad campaign website, which Quiznos defended on 47 USC 230 grounds.

Citing the MCW v. Badbusinessbureau case from 2004, the court says "the critical inquiry with respect to CDA immunity in this case is whether the Defendants merely published information provided by third parties or instead were actively responsible for the creation and development of disparaging representations about Subway contained in the contestant videos."

The MCW decision was questionable even at its time, but it's bizarre to see the court reach into history for this obscure, archaic, unpublished and geographically distant (it was a TX precedent being cited in a CT court) district court precedent. To do this, the court bypasses dozens of more recentand more thoughtfulcases, including the multiple Ripoff Report cases that have expressly and implicitly rejected the MCW case. A more natural citation would have been the Roommates.com case, which also referenced legal distinctions between active/passive websites similar to the legal standard quoted above. However, if the court had followed Roommates.com, it almost certainly would have ruled for the defense, as Quiznos didn't require illegality or even channel users towards illegality. (Rebecca makes the same point). Therefore, I'm baffled how the court got to this legal standard citing this legal precedent.

Using this odd legal standard, the court says it's up to the jury to decide if Quiznos just exercised traditional editorial control or impermissibly "actively participated in creating or developing the third-party content submitted to the Contest website."

Unquestionably, sending this case to a jury is a 230 loss, but how bad is unclear. We'll never find out what the jury would do with the case because the parties promptly settled the case after this ruling. However, a plaintiff's ability to hold a case open through trial, rather than having it disposed of earlier in the proceedings, would itself represent a significant win for plaintiffs--it would mean plaintiffs can get discovery to fish for embarrassing facts, force the defense to incur lots of litigation costs, and get a chance to tell their sob story before a jury. (FWIW, I am not aware of any 230 case that has ever reached a juryam I forgetting something?) Nevertheless, I think very few courts will follow this precedent given the plethora of more persuasive precedents and the fact that Quiznos' crowdsourced ads were just one part of Quiznos' larger allegedly false ad campaign. Therefore, I don't expect this 230 loss to spread to many other cases.

I also don't think this case shines much light on the legitimacy of crowdsourcing ads. There's no reason to believe that crowdsourced ads are per se problematic. At the same time, if the advertiser uses the ads offline, clearly the advertiser "adopts" the ad and takes full responsibility for its contents. If the advertiser only publishes the ad online, 230 might be available but the advertiser still might tread cautiously due to the FTC Endorsement and Testimonial Guidelines, which basically ignores 230 and holds advertisers liable for certain types of third party advertisements anyway. I think 230 may nullify this part of the FTC guidelines, but most advertisers would rather not tangle with the FTC to establish the deficiencies in the FTC's thinking. As a result, I expect most advertisers will vet most crowdsourced ads, even if they only publish them only, as if the advertiser is legally responsible for the ads and not protected by 230.

BTW, the Subway v. Quiznos lawsuit isn't the only litigation over subway restaurants' claims of double meat. In an apparently unrelated lawsuit, last month a class action suit was filed over Blimpie's "Super Stacked" sandwich for overclaiming that it had double meat.

I confess some schadenfreude when I see lawsuits against meat pushers for overhyping meat quantities. I would not shed a tear if the meat pushers lock up each other in litigation death struggles and sue each other to oblivion. Of course, consumers can facilitate that outcome by refusing to patronize vendors who "compete" with each other by encouraging us to overconsume the Earth's resources.

There could be no clearer example of fair use -- but the video was still taken down. There was some dispute at the time as to whether or not this was an actual DMCA takedown, or merely YouTube's audio/video fingerprinting technology (which the entertainment industry insists can understand fair use and not block it). But, in the end, does it really make a difference? A takedown over copyright is a takedown over copyright.

Amazingly enough, it appears that almost the exact same thing has happened again. A video of one of Lessig's presentations, that he just posted -- a "chat" he had done for the OpenVideoAlliance a week or so ago, about open culture and fair use, has received notice that it has been silenced. It hasn't been taken down entirely -- but the entire audio track from the 42 minute video is completely gone. All of it. In the comments, some say there's a notification somewhere that the audio has been disabled because of "an audio track that has not been authorized by WMG" (Warner Music Group) -- which would be the same company whose copyright caused the issue a year ago -- but I haven't seen or heard that particular message anywhere.

However, Lessig is now required to fill out a counternotice challenging the takedown -- while silencing his video in the meantime:
While you can still see the video on YouTube, without the audio, it's pretty much worthless. Thankfully, the actual video is available elsewhere, where you can both hear and see it. But, really, the fact that Lessig has had two separate videos -- both of which clearly are fair use -- get neutered due to bogus copyright infringement risks suggests a serious problem. I'm guessing that, once again, this video was likely caught by the fingerprinting, rather than a direct claim by Warner Music. In fact, the issue may be the identical one, as I believe the problem last year was the muppets theme, which very very briefly appears in this video (again) as an example of fair use in action. But it was Warner Music and others like it that demanded Google put such a fingerprinting tool in place (and such companies are still talking about requiring such tools under the law). And yet, this seems to show just how problematic such rules are.

Even worse, this highlights just how amazingly problematic things get when you put secondary liability on companies like Google. Under such a regime, Google would of course disable such a video, to avoid its own liability. The idea that Google can easily tell what is infringing and what is not is proven ridiculous when something like this is pulled off-line (or just silenced). When a video about fair use itself is pulled down for a bogus copyright infringement it proves the point. The unintended consequences of asking tool providers to judge what is and what is not copyright infringement leads to tremendous problems with companies shooting first and asking questions later. They are silencing speech, on the threat that it might infringe on copyright.

This is backwards.

We live in a country that is supposed to cherish free speech, not stifle it in case it harms the business model of a company. We live in a country that is supposed to encourage the free expression of ideas -- not lock it up and take it down because one company doesn't know how to adapt its business model. We should never be silencing videos because they might infringe on copyright.

Situations like this demonstrate the dangerous unintended consequences of secondary liability. At least with Lessig, you have someone who knows what happened, and knows how to file a counternotice -- though, who knows how long it will take for this situation to be corrected. But for many, many, many other people, they are simply silenced. Silenced because of industry efforts to turn copyright law into something it was never intended to be: a tool to silence the wider audience in favor of a few large companies.

The system is broken. When even the calls to fix the system are silenced by copyright claims, isn't it time that we fixed the system?

Now that AT&T has joined the Android revolution, the first question new Android users will ask is what Android apps should I download? Luckily we've created a simple guide to get you started:

First we'll start with the operating system version of the Motorola Backflip at launch, which is version 1.5 :-( the latest and greatest to date is 2.1 (with majority of users on 1.6). This may affect your ability to download some apps as they are compatible with higher versions of the OS. Why is the OS version so out of date? I'm heading to Tampa, Florida for a couple of days to take care of some business. I have my second thesis defense at the University of South Florida, and tomorrow I'm scheduled to give a teleseminar with the Poynter Institute about producing news with with smartphones.

My mobile media journey started a couple of years ago when I used Twitter to share news from the field as I covered the 2008 Gulf Coast storm season for the now defunct HDNews. I don't know how many journalists were doing it at the time, but I found Twitter and hashtags (like #Ike and #gustav) to be a great way to share first hand accounts of what I was witnessing from the field during Tropical Storm Fay, Hurricane Gustav, Ike and Tropical Storm Hanna.

I also used my blog to post the stories that we produced from the field and I shared footage that wasn't included in my stories. Oh if only the iPhone 3GS was out back then. The iPhone and other smartphones like the Android and Nokia models make it extremely easy to share video from anywhere. Other applications and sites like TwitPic allow easy photo sharing.

We all know that media can't be every. But people with these devices are everywhere, and it's changing the face of news and information. As an example, check out these pics from the Chile earthquake that were posted via Twitter.

Of course I can't share all of my secrets, but if you check out this Webinar, you should have a greater understanding of now TV news stations, and vloggers like myself are using technology to innovate the gathering of content.

WTTG Fox 5 in Washington DC, and KOB in New Mexico are doing a great job of experimenting with technology to enhance coverage.

I'll probably be posting mostly mobile videos, so keep it tuned to either my Twitter account, or check back here for the latest video updates.

For instance, if I post an article or video related to Apple, the Windows fans go ballistic. Likewise, whenever I posted something Windows-related, the Mac fanboys blow a gasket. It's like there's no happy medium these days. I cannot possibly make everyone happy all at once. I'm not even going to try!

However, I DO strongly believe that what we're doing is about the community, not just for the community. So I want to know what YOU think. What do you want to see more of in the coming months? What things can you live without? Leave a follow-up comment here, or drop me an email with your thoughts.

Last week I ran into Brad Murphy, the Chief Revenue Officer (CRO) / Vice President of Sales for Revision3, the television network for the Internet generation at a Placement Scout product placement event at Tesla Motors in Santa Monica. Well, OK I didn't really run into Brad, I told him and a few other web video producers about the event because I thought it would be a good chance for us to get our shows in front of brands that might benefit from the special engaged audiences that web videos have.

In my video interview with Brad he talks about how the Revision3 audience is made up of what he calls, Digital Natives people who don't watch regular television, are looking for content on-demand whether it's text based content, video content or communicating through social media to find that content. It's an audience that hyper-connected.

Brad also goes on to talk about the live events that Revision3 does with their shows. (Something I'm hoping to do more of with my shows.)

- Lulu will take PDF files for a book. Blogbooker.com will try to create a PDF from a blog. Unfortunately, my blog made BlogBooker choke (I have 991 posts from my blog) even when I excluded comments.

- Blurb.com will try to create a book from a blog, but it only supports blogs hosted on WordPress.com, not other WordPress blogs. That will help some people who want to print their blog into a book, but not everyone.

- I had the best luck with FastPencil. In order to reduce the size of your exported blog, you'll first want to go to your comments section, click on the spam link and clear out any spam comments by selecting all the spam comments and clicking Empty Spam. Then you can export your WordPress blog (from the Dashboard, click Tools, then Export) as an XML file that you can download to your computer. From there, FastPencil lets you upload the .xml file and then select which blog posts to include in the book. You can also filter by time, which I had to do. Even my blog posts (no comments) from the last year and a half still made a 350+ page book, and FastPencil choked on turning my entire blog into a book.

FastPencil did a few things well. Included images were imported, and some formatting such as bold made it into the PDF. But other formatting, such as code formatting and newlines/spacing between paragraphs didn't make it. Embedded content such as videos or polls were likewise empty. Trying to import my entire blog also didn't work. But all in all, I was impressed with FastPencil. They also have nice collaboration tools (e.g. you can designate editors, reviewers, co-authors, and project managers to help in writing/polishing the content). The site also works through your web browser instead of as a downloadable program, which appealed to me. If you're used to WordPress, FastPencil won't be too much of a change.

It's still not a point-and-click affair to make a nice looking coffee table book out of a blog, but it's getting closer. Right now, the make a book niche feels like the early days of recordable CDs. Back then, CD-R discs were expensive enough that I would spend time to make sure that I used all the free space on the CD. Eventually prices dropped so much that you didn't feel bad about burning a half-empty or not-perfectly-polished CD.

SFWeekly Web Editor Alexia Tsotsis (not pictured left) spent some time early this morning trying out Chatroulette, a website that connects random strangers for a video chat. The results are unlikely to surprise you. Unless you are new to this whole Internet thing. Screen shots of some of her more entertaining chats are below the post.

Harkening back to the days of A/S/L, the random vidchat service Chatroulette is one of those online arenas where not being a white male looking to get off puts you in a definite minority. Founded by a 17 year-old Russian high school student named Andrew Ternovskiy, the service is a more successful Omegle, combining elements of the MTV show Next with vidchat capabilities.

Aspiring chatees click to play and as an escape latch you or your partner can hit Next anytime if you get bored, scared, or have to get back to work. The Report video as inappropriate button also seems to provide some comfort, but by judging by the nsfw fare served to me last night, doesn't provide much of a threat.

I pressed play last night at around 3:00 am PST and after about 45 clicks on Next encountered 5 straight up penis shots, a lot of camera disabled chats, two women who automatically clicked Next once they figured out that I too was a female, and a lot of very grateful looking guys, including a Chinese fan of Google and a French guy in indoor sunglasses, who asked me whether I was a more dominate lady or submissive woman in the hope that I would be the former.

Out of the 10,920 of my fellow Chatroulette participants, my Roulettees were a good cross section of Internet humanity. And while I did not encounter the suicide hanging videos alluded to in many of the chats, things like did you hear the one about the guy who shot himself in the bath tub, were brought up in conversation quite a few times, as examples of just how crazy Chatroulette can get.

Anywhere you get a mass of people communicating uncensored (and yes much like 4chan.org, China has not yet blocked Chatroulette) will be subject to typical groupthink behavior like urban myths and requests for interaction better left to the casual encounters section of Craigslist. Nonetheless, the service's potential for more substantial acts of communication is formidable.

Chatroulette is what you'd expect it to be, micro-interactive reality TV with a large heaping of cybersex. While most people are (whether they admit it or not) voyeurs the fact that Chatroulette lets the both participants see each other limits the site's potential user base to the weirdos and despite piquing VC Fred Wilson's interest it doesn't seem like there's currently enough weirdos to turn the humble startup into something mainstream.

One Roulettee, when asked what he thought the service was most useful for, responded, connecting with people around the world. Yeah, and asking them to show you their boobs.

We Americans like to think of ourselves as trendsetters for the rest of the globe, but when it comes to cell phones, we're still playing catch-up with countries such as Japan and Korea.

In general, Asians use their cell phones in more robust ways than the typical U.S. resident as TVs, wallets, GPS devices, and music players. Japanese cell phones can double as a house key, a credit card, and an ID. Users can even use their cell phones to send their vital signs straight to their doctors.

In recent years, U.S. companies have made baby steps toward incorporating more advanced cell phone features, particularly in the areas of mobile banking and video broadcast. Meantime, the Asian cell phone market continues to be a good predictor of features that could soon be included in American cell phones. For example, Japan had cameraenabled cell phones two years before Americans ever went gaga for them.

Curtis Schenck, a manager of corporate relations at NTT DoCoMo USA, gave TechNewsDaily the scoop on the hottest features in the Japanese market right now. Try not to be too jealous.

1. Personal Butler

Customers don't have to Google for information, since i-Concierge acts as their butlers or personal assistants and caters to their every need. Users can input their food preferences, neighborhoods they like, and entertainments that they enjoy. When new information is downloaded into the system, they get push notifications that are based on their preferences. For example, if they like Thai food and a new Thai restaurant that is opening nearby, their cell phones will notify them.

2. Investigative Visits

This takes the Verizon commercials to a whole new level. If a users' five-bar reception signal drops to three bars or if they have a dropped call, they can call customer service and a team will be sent out to investigate the problem.

3. Barcode Reader

Japanese phones can read QR marks, which are sophisticated barcodes for businesses. If an Asian cell phone user is walking down a Tokyo street and walks past a restaurant that isn't open, they can point their camera to the QR mark and their phone's browser will automatically be routed to the restaurant's Web site.

4. Free TV on the Phone

Subscribers can surf 13 free TV channels on their phones. DoCoMo has also launched their own channel called BTV to air programs that are filmed specifically for the mobile phone.

5. Phones as Payment Systems

Osaifu Keitai, also known as the mobile phone wallet, lets users load up credit card information onto their phones. If stores have a reader, users can swipe their phones over it to pay for their purchases. Cell phones can also be used to pay for subway and train tickets.

6. Send Money to Other Subscribers

Some Asian countries allow users to send money using their cell phones. Users simply input another person's phone number and the amount they owe them and like magic, the money is transferred.

7. Internal Wi-Fi Spot

Japanese cell phone users can download a movie onto their mobile phones and show it on their TVs. This is another way to get entertainment on demand. A femtocell base transceiver station (BTS) in the home hooks up mobile phones to the DoCoMo network through a broadband line such as an optical fiber. The femtocell BTS lets a person with a cell phone download videos and music files. Through femtocell BTS, a person can set up a private wireless network for their home appliances, entertainment systems, and other devices.

8. Home Security Service

Japanese cell phone users can lock their doors and manage their home security systems remotely using their mobile devices. They can also adjust appliances and set environmental controls, so their lights and heat can be switched on before they get home.

9. Environmental Awareness

DoCoMo has deployed environmental sensors throughout Japan and people are now able to monitor air quality, temperature, and UV rays around them using their cell phones.

10. Reads Vital Signs

In the same way that we might plug headphones into our iPhones, Japanese cell phone users can plug in equipment such as a blood pressure monitor to their phones and send vital signs directly to their doctors. This helps save some people a trip to the doctor.

Customers don't have to Google for information, since i-Concierge acts as their butlers or personal assistants and caters to their every need. Users can input their food preferences, neighborhoods they like, and entertainments that they enjoy. When new information is downloaded into the system, they get push notifications that are based on their preferences. For example, if they like Thai food and a new Thai restaurant that is opening nearby, their cell phones will notify them.

2. Investigative Visits

This takes the Verizon commercials to a whole new level. If a users' five-bar reception signal drops to three bars or if they have a dropped call, they can call customer service and a team will be sent out to investigate the problem.

3. Barcode Reader

Japanese phones can read QR marks, which are sophisticated barcodes for businesses. If an Asian cell phone user is walking down a Tokyo street and walks past a restaurant that isn't open, they can point their camera to the QR mark and their phone's browser will automatically be routed to the restaurant's Web site.

4. Free TV on the Phone

Subscribers can surf 13 free TV channels on their phones. DoCoMo has also launched their own channel called BTV to air programs that are filmed specifically for the mobile phone.

5. Phones as Payment Systems

Osaifu Keitai, also known as the mobile phone wallet, lets users load up credit card information onto their phones. If stores have a reader, users can swipe their phones over it to pay for their purchases. Cell phones can also be used to pay for subway and train tickets.

6. Send Money to Other Subscribers

Some Asian countries allow users to send money using their cell phones. Users simply input another person's phone number and the amount they owe them and like magic, the money is transferred.

7. Internal Wi-Fi Spot

Japanese cell phone users can download a movie onto their mobile phones and show it on their TVs. This is another way to get entertainment on demand. A femtocell base transceiver station (BTS) in the home hooks up mobile phones to the DoCoMo network through a broadband line such as an optical fiber. The femtocell BTS lets a person with a cell phone download videos and music files. Through femtocell BTS, a person can set up a private wireless network for their home appliances, entertainment systems, and other devices.

8. Home Security Service

Japanese cell phone users can lock their doors and manage their home security systems remotely using their mobile devices. They can also adjust appliances and set environmental controls, so their lights and heat can be switched on before they get home.

9. Environmental Awareness

DoCoMo has deployed environmental sensors throughout Japan and people are now able to monitor air quality, temperature, and UV rays around them using their cell phones.

10. Reads Vital Signs

In the same way that we might plug headphones into our iPhones, Japanese cell phone users can plug in equipment such as a blood pressure monitor to their phones and send vital signs directly to their doctors. This helps save some people a trip to the doctor.

To be fair, these two developments are really far apart in their delivery dates. The Gmail status update could come as soon as tomorrow, whereas the the speech-to-text-to-speech translation system is still a ways out. You can definitely see just how much work Google needs to do by trying to read your Google Voice voicemail transcriptions. (Voice search works better on Android 2.1 because you're talking slower and enunciating.) But both these features point in the same direction many of the company's other products have been hinting at. Here's a list of Google's major products, in case you forgot, and which sector of communication they want to dominate.

Google Voice: This is a big one, and it'll be the most natural interface for Google to slot in the voice-translation into. If you're using it the way Google wants you to use it, you're already piping all your voice calls and SMS through Google's tubes. And refining speech to text gives them a good idea of your interests and what you're talking about, allowing them to better serve up the relevant ads to you during calls.

Update: Thanks commenters, for reminding me that Google made Wave open, so people can create their own Wave servers to talk to each other with the Wave protocol. The point still remains, that if you were going to use a service, wouldn't you rather use the service from the company that created the protocol, for performance and feature reasons?

My Thoughts On Techcrunch And Daniel Brusilovsky

This was going to be a video, but frankly I'm too upset and I don't want my sentiments to be lost while you stare at my good looks and get hypnotized by my command of language and performance.

We are at a crossroads on the web and social media. It's time to start looking at ourselves with an honest eye. Today's topic is journalism and transparency.

I'm in no way a journalist but here's my transparency. I had a falling out last year with ManCrunch founder Michael Arrington. I honestly adored him, and would vigorously defend his general dickish and insane behavior to anyone who ever asked which was essentially everyone. I would say Mike is just like me, you just don't get his humor. I would do anything for him, he's been great to me.

Then Mike called to cancel his speaking appearance at The Audience Conference. Yeah I was in the car driving to the event when he called, but I tried to laugh it off. I knew all along he was gonna bail, and frankly being a friend and knowing that Mike can be Mike I really didn't care and was willing to let it slide, even though this was the second time he screwed up. He apologized the first time and we were cool. The second time he wrote some silly post on ManCrunchNotes about friendship and puppies. I like dogs too and considered the matter closed.

Then I watched him do the same thing, only worse and at a much larger scale, to another friend of mine. And then another. Then I heard some other stuff, which everyone else is mumbling about. Then I thought back to the way he treats his staff and realized that even though it makes for great puppet videos that nobody watches, It's just not my style to hang with a guy like that.

But that was months ago. My thoughts about TechCrunch in this post are not part of some revenge plot between an internet puppeteer who gets a few hundred views per YouTube video and a bigtime lawyer who claims millions of readers yet only generates a few dozen clicks each of the 20 times I've been on the front page of his site.

Daniel Brusilovsky, the latest character in the sad tale of TechCrunch, is 17 years old. Excluding Mike's puppy, this makes him the youngest contributor to the site.

Other TechCrunch contributors include Sarah Lacy, who earned her chops getting laughed off the stage interviewing Mark Zuckerberg of Facebook, and fellow auteur Paul Carr, who documented his unethical behaviors in a book you can download for free on TechCrunch. Paul's other hobbies include Foursquare checkins, and delaying writing the words he's under contract to write.

One of Sarah's more popular TechCrunch posts was talking about a juice diet product that costs $95 per day, which she totally paid for herself, which may or may not be repped by people close to Mike and companies that Mike invested in. Paul Carr tried it too. Even Mike gave the juice a go, or at least the puppet did I forget. Sarah also travels a lot which you can tell by the deep international flavor of her TechCrunch coverage and analysis. Or at least the pictures she posts on other sites.

There are other people at TechCrunch that I dig. I'm still mad that Hendrickson left because that threw off my puppet gag. And Schoenfeld did a great job filling in as master of ceremonies for Mike after Mike threw a tantrum and disappeared three hours before his own award show. I did a quick Google and he didn't call Arrington a total jackass even once for it. So props for that. There are others too but I'll spare them Mike's wrath by not mentioning them.

Bringing up the rear is Steve Gillmor who is the oldest TechCrunch employee at 157 years old. He's basically known for his unique talent for speaking in tongues. Tech style y'all. Yesterday Steve broadcast himself screaming at his assistant while being unable to use the copycat audio/video technology he bought for himself to compete with Leo, after he uh, left Leo's network amicably.

Since you haven't heard about Gillmor Gang let me tell you what it is.

The Gillmor Gang may or may not be a TechCrunch production. It consists of non-technical people yelling at each other about technology and runs for what feels like eleven hours. Visuals focus on odd angles of nostril hair, bad cell phone call-in audio, and lighting that makes them look like lizards. Their most popular video is a 90 second YouTube clip where keyboard cat plays jazz organ after Mike acts like an idiot, a Google employee throws his Skype headset down in disgust, and I roll my eyes uncomfortably.

This four screen picture-in-picture view was made possible by Leo's mastery of the tech that Gillmor still hasn't figured out how to use. You probably won't be able to find the site in Google since it changes URLs every ten minutes but you can probably find the keyboard cat clip on YouTube. If you bump into Leo Laporte, don't mention that you've seen it.

Unofficial TechCrunch employees include Robert Scoble, ex-camera salesman and Microsoft Vista evangelist. Today Scoble is again throwing around his journalism credentials (he dropped out of j-school) in defense of Daniel and Mike. I'll just point out that if you have to constantly tell people you're a journalist, there might be something lacking from your body of work. Even in this jaded age people tend to be able to smell actual reporting and it's not coming from building 43 at the Rackspace headquarters. Although it was fun to watch the Rackspace head of social media flop around on Friendfeed after the latest Gillmor Gang episode blew up. Cool site that Friendfeed. Somebody big should buy it and really fix up that community. And way to pick a winner in Scoble, Rackspace. Haven't seen a play this brilliant since you screwed up Slicehost.

But back to reporting. Closest Scoble ever got to a story was interviewing the guy who sells yogurt to Steve Jobs. Scoble reported that Steve Jobs was in great health. Jobs left Apple four days later for a liver transplant. Scoble was also on the private jet the day John Edwards announced his run for the Presidency, shooting video three feet away from the other video blogger who was John Edwards mistress and who mothered his child. Didn't pick up on that vibe either I guess. He sure has his thumb on the pulse.

So on the one hand I want to give Daniel Brusilovsky a pass. The kid is 17 and look at the environment he's working in and the idiots he's surrounded by. I'm tempted to blame the parents, but hey, there's no way they'd know this stuff.

Let's pretend for a moment that Dan is not some privileged little schmuck and that his parents aren't connected to Silicon Valley in some convenient way for Mike and/or Scoble. Let's imagine that the parents actually performed due diligence and took five minutes to Google the people their kid would be spending time with.

Wow. Well-adjusted, social, popular people. With lots of friends. And friendly Wikipedia entries. And they all love tech!

We all know this is utter bullshit. This is the world we've created on the web.

So before you yell at Dan, look at yourself. I know personally that lots of you know lots of things and you don't say the Stuff That Matters.

It's okay to call people idiots, or dopes, or morons, or liars when they are. This is part of the process of transparency.

Although it's probably not that helpful, you can even get away with being mean for no good reason. Here goes. Robert Scoble really is fucking stupid. Every smart person I know thinks so. Shel Israel really is a nasty prick. If you've actually tried to work with him, you know this. See? The internet didn't just collapse.

And yeah, TechCrunch has become a joke.

It's okay to say this stuff. In fact we have to say this stuff if we want to improve. You'll badmouth a restaurant for lukewarm fries on Yelp but you won't say that Rackspace Spokesman Scoble is a fool for thinking a VPN is a Virtual Public Network? One time is a slip of the tongue and we all make mistakes, but this guy has been on the wrong side of history going back a decade and clearly doesn't know anything.

It's also okay to promote other people who do great work. I don't care if it's Follow Friday or Tumblr Tuesday or ManCrunch Monday, take a minute next time and really find and promote Someone Who Matters. And if you can't find that someone, perhaps reflect on the web of connections you built and why you're wasting your time with them. Let alone endorsing them by keeping them in that little grid of profile pictures you're so proud of.

So yeah, I want to give Dan Brusilovsky a pass given the entire environment. But I can't.

I've met him several times and thought he was a smug little prick. Some kids are kids, some adults like Mike are kids, and some 17 year old kids know exactly what's up. My opinion is that Dan is a Man and falls into the last category. He knew what he was doing and deserves the consequences.

Should Mike have done a better job mentoring him? Absolutely. But look at Mike. He can't take care of himself in any way or even show up to the parties and conference circle jerks he throws himself. He seems to do an okay job with the puppies but I wouldn't trust him with an up-and-coming 17 year old tech reporter.

Mike's transparency post also deserves a little attention. It says nothing. It doesn't mention the company or companies involved in the alleged laptop-for-coverage scandal. I'm sure it'll all get figured out eventually, and it might even be a company that's a friend or sponsor of mine. But in the spirit of saying Stuff That Matters, I'll close with this:

If you bought a MacBook Air in order to get a 17 year old to write a post on TechCrunch, and you thought this would in any way improve your business, you're an absolute, total dope.

Although it's probably not that helpful, you can even get away with being mean for no good reason. Here goes. Robert Scoble really is fucking stupid. Every smart person I know thinks so. Shel Israel really is a nasty prick. If you've actually tried to work with him, you know this. See? The internet didn't just collapse.

And yeah, TechCrunch has become a joke.

It's okay to say this stuff. In fact we have to say this stuff if we want to improve. You'll badmouth a restaurant for lukewarm fries on Yelp but you won't say that Rackspace Spokesman Scoble is a fool for thinking a VPN is a Virtual Public Network? One time is a slip of the tongue and we all make mistakes, but this guy has been on the wrong side of history going back a decade and clearly doesn't know anything.

It's also okay to promote other people who do great work. I don't care if it's Follow Friday or Tumblr Tuesday or ManCrunch Monday, take a minute next time and really find and promote Someone Who Matters. And if you can't find that someone, perhaps reflect on the web of connections you built and why you're wasting your time with them. Let alone endorsing them by keeping them in that little grid of profile pictures you're so proud of.

So yeah, I want to give Dan Brusilovsky a pass given the entire environment. But I can't.

I've met him several times and thought he was a smug little prick. Some kids are kids, some adults like Mike are kids, and some 17 year old kids know exactly what's up. My opinion is that Dan is a Man and falls into the last category. He knew what he was doing and deserves the consequences.

Should Mike have done a better job mentoring him? Absolutely. But look at Mike. He can't take care of himself in any way or even show up to the parties and conference circle jerks he throws himself. He seems to do an okay job with the puppies but I wouldn't trust him with an up-and-coming 17 year old tech reporter.

Mike's transparency post also deserves a little attention. It says nothing. It doesn't mention the company or companies involved in the alleged laptop-for-coverage scandal. I'm sure it'll all get figured out eventually, and it might even be a company that's a friend or sponsor of mine. But in the spirit of saying Stuff That Matters, I'll close with this:

If you bought a MacBook Air in order to get a 17 year old to write a post on TechCrunch, and you thought this would in any way improve your business, you're an absolute, total dope.

As such, identifying new revenue models will be instrumental in kicking off the next cycle of the social networking phenomenon in 2010.

CEO Mark Zuckerberg has set an aggressive agenda for the company, publically stating that he expects social networks to become as essential as web browsers and operating systems, and he has set the lofty yet entirely realistic goal of 1 billion users worldwide.

In the less than five years since it expanded beyond scholastic audiences, Facebook has not only grabbed the lion's share of users, it has engaged them like no other platform on the Internet. The average Facebook user visits the site at least once a day and spends an astounding 55 minutes engaging friends and family - statistics that another Zucker (Jeff) would probably kill for over at NBC.

While translating such popularity into dollars and cents isn't easy - especially in an industry whose users have grown accustomed to getting something for nothing - Facebook could potentially provide a monetization template that would revolutionize social networking as we know it.

The Next Level of Advertising Revenue

Advertising has traditionally provided the simplest means of generating revenue. PricewaterhouseCoopers reported in October that Internet advertising revenues totaled $10.9 billion for the first half of 2009. It's been estimated that Facebook alone took in $435 million of that total. Consumers and companies would flock to a Facebook storefront for one simple reason: We do everything else there. Imagine an integrated, one-click solution whereby your friends see your recent purchases (because you were incentivized by the brand to share your information) in their feed and are able to simply point, click, and purchase the same item.

With a few adjustments, companies can make timely offers of birthday gifts for friends, travel arrangements for event items, or the latest music from favorite artists - and make the sale without forcing the user to leave Facebook or put in new login information.

Rather than driving their 350 million users away from the platform to close the deal with retailers and purchase the item on an external platform, Facebook could benefit financially by charging companies a percentage of sales, a fixed rate to have a storefront, or from increased advertising opportunities.

Premium Subscription Options

Users (whether they are corporations or teenagers) are amenable to paying for even the simplest features and functionality, as evidenced by the success of Facebook gifts.

Nothing good in life is free. It's a stark, mature reality that Facebook (and its users) need to face in 2010. By leveraging economies of scale, Facebook can churn a sizable profit without alienating users. Would you pay one dollar a month to share higher-resolution photos or upload higher-quality or longer videos? Last month, 2.5 billion photos were uploaded to Facebook. Even if only a quarter of the site's active users opted for premium options, this one change would generate more than $1 billion in annual revenues.

Improving advertising, developing an e-commerce platform, and adding subscription services will not only generate the revenue necessary to make the transition from highly adopted to highly profitable, it will open revenue streams as Google did before for the next generation of digital developments.

I wanted to make sure that I'm writing as objectively as I can and not just let my emotions get the better of me. That being said, here are my thoughts on Apple's iPad.

The world has waited quite awhile for Apple to finally release its tablet. The world wanted it so much that in a way it worked against Apple. People built up their expectations of the iPad so high that it was going to be tough for Apple to surpass it. Did they? The simple answer is no. The iPad falls short of the world's lofty expectations. Is it Apple's fault? Not totally.

The world wanted Apple to produce a breakthrough device so much that when Jason Calcanis, founder of Engadget fired of tweets saying that he had been a beta tester for Apple and started to rattle off specs that were too good to be true, people believed him (this writer included). Why not? He's been writing about the tech industry and is one of the more recognizable names in the blogosphere that it seemed plausible. I hindsight, the solar panels should have been a dead giveaway.

On to the iPad. At first glance it does indeed just look like a big iPod Touch. Is it revolutionary and magically as Apple said it is? It should be had the world not been exposed to the iPhone and iPod Touch prior to it. On its on it is still revolutionary. Here's why.

1. The size is a big factor Sure it may look like a big iPod Touch but the bigger form factor just opens up a lot more possibilities. I've been a long time user of the iPod Touch and iPhone. I have both the first generation of iPod Touch and iPhone and thus have a little bit of experience with the devices. They both are great mobile devices. For checking important emails, looking up stock and weather quotes, reading a short article on the internet that really can't wait both these devices are top notch. But for reading books, watching movies, etc. It's just ok. After awhile your head starts to spin because of the eye strain and makes you want to put it down. The iPhone and iPod Touch are great mobile devices that can be used for short periods.

On the areas that the iPod Touch and iPhone are lacking, I think this is where the iPad starts to shine. Its size makes for an excellent device to watch videos on. The screen is large enough for personal viewing that it doesn't become such a chore. Reading books should be easier too although I shall reserve judgment on that until I actually get to try it.

2. Keeping it Simple - I've heard about a lot of people saying that the iPad lacks multi-tasking, etc. but I believe that Apple's attitude of keeping the iPad simple is actually is a strength. We've been surrounded by a culture of multitasking that it's gotten to a point that it's become a hindrance rather than helpful. When we work on our computers, we often find ourselves doing email, chatting, reading web pages all at the same time. It's becoming confusing and our concentration is suffering. I'm not saying this is always bad but in some cases keeping focus on things is good.

I also believe that the target users for the iPad are really people who aren't that techie. Let me qualify this. I'm not saying these people don't like technology or are adverse to it. I'm saying these people are the ones that like technology that just works. That's why a lot of people play games on consoles. Sure they can play games on the PC but it takes so much work to do so. Consoles are simple. You place the game, you play. Simple. The iPad is pretty much simple as well. It won't take rocket science to figure it out.

3. Touch me - The touch interface feels natural. It's been around for awhile but Apple's iPhone/iPod Touch interface that has been adapted for the iPad is the most natural touch interface I've seen. It's not a PC interface that has been adapted for touch. It's actually designed with the touch interface in mind. Therefore it just feels natural. People who aren't tech oriented really don't have a hard time figuring it out. Case in point, my tech challenged mother didn't have a hard time learning her iPhone.

4. It's what inside that counts In this case, one of the biggest things about the iPad announcement is actually the processor. Apple now has it's own processor inside one of its devices. It actually looks pretty good. If the impressions of people that have had a chance to play with the iPad. This thing screams and isn't power hungry. If this chip finds it way to the iPhone, we'll have quite the smart phone on our hands.

The iPad was designed to fill a gap between the netbook and a smar tphone. Will it do that? I think to a certain extent it will. I envision people buying this to have them in their homes and have easy access to email, photos, videos. Sometimes you just want to share photos with a friend and not necessarily project it on the TV. The iPad is a good alternative.

I also see it as a good addition to people who have desktops but want something portable to bring around the house to check emails, watch videos from anywhere and yes that includes the bathroom. I don't think it will get hot enough to burn your crotch as a MacBook/MacBook Pro does.

Will it revolutionize the way the iPod has? It has the potential to do so but only time will tell. For a 1.0 product it's good. I'm sure as with the iPod and iPhone the succeeding versions will only be better.

Samsung seems to be popular this week for unboxing videos this week. We follow on from the N220 unboxed to the X120. Like the N220, the X120 is currently not shipping in America.

The Samsung X120 falls in the CULV category as it features the Intel CULV processor. The X120 features an 11.6 inch display and a full sized keyboard. The left and right mouse buttons are located either side of the trackpad, which for some may hinder the use of the built in mouse, especially if you're used to the right and left buttons being located under the trackpad. The guys over at Netbook News received the X120 and have posted an unboxing video along with first impressions design wise. Like the other Samsung netbooks, the accessories include a neoprene sleeve to protect the netbook, however it's noted that no manual is included, not even a quick start guide. The X120 also has the trademark chrome border. Looking at the underneath, it appears that the HDD and RAM are easily accessible for those who wish to upgrade either. Beyond the aesthetic compatibility of mid-century furniture and Apple design, what makes the detail notable is that in past years Steve always delivered Apple keynotes standing. Here, each time he went to demo an aspect of the iPad, the CEO sat downa subtle shift that speaks volumes about how this new device might fit in to our lives.

Not meant to replace computers used on desks or the phone that goes with you everywhere, it's an in-between device. The gadget's design makes it perfect to use in the living room, on an airplane or during morning commutes (as Apple illustrated in this video).

At first glance, the wide, black bezel surrounding the iPad's screen perplexed me; it seemed to be a step backwards from my long-standing belief that the evolution of screen technology is full-bleed. Upon using the device, however, it became clear that that the edge necessarily gives you a place to grip it without accidentally touching the on-screen interface. It turned out that the 9.7 inch, 1024x768 pixel screen looks so gorgeous that I quickly forgot about this concern all together, instead immersing myself in content.

For all intents and purposes, this 1.0 version of the iPad is a large iPod Touch, a development that lends the new device familiarity and ease-of-use. The iBook store and touch versions of iWork applications are a welcomed addition and the ability to run iPhone applications out-of-the-box is more necessity than benefit.

Pictures and videos really show off the beauty of the device's screen and benefits of its connectivity; the redesigned version of Apple's media apps are perfectly tailored to the postures and situations where we'll be using our iPads. And the touch-keyboard really does work well.

What I'm most excited about, however, is simply web browsing. While the lack of Flash presents an issue, sites built for modern computer-based browsers fit, look and perform beautifully on the iPad. Especially thrilling, was previewing how beautiful the upcoming Cool Hunting redesign looks on the device. (Pictured at right.)

The iPad is not the transformational device so many Apple enthusiasts were hoping for. It won't turn all the content industries upside down, it won't be your primary computing device, and it's not even a bigger, better iPhone.

Apple CEO Steve Jobs introduced the iPad as a device to fill the gap between smartphones like the iPhone and high-end laptops like the MacBook and MacBook Pro. He said there needs to be a middle device, but it needs to be better than the alternatives at what it does. Netbooks currently fill the void, but according to Jobs, netbooks aren't better at anything. He and his colleagues at Apple believe that the iPad is.

Apple's website and promotional video call the iPad magical. We're told the iPad is the best way to experience the web, email, photos, and videos. Hands down. But it's not it's not even close. It's mighty cool, it's super convenient, and it's very sexy, but it's not even better than a netbook at some of those things.

This isn't the middle device folks have been waiting for because and I'm using Steve Jobs's own criteria here it's not better at anything than any other device on the market. It's a step in that direction, but the day hasn't come yet. Here are just a few of the ways the iPad isn't as magical as Apple claims.

It's Not the Best Way to Browse the Web

Steve Jobs said it needs to be a better web device than the alternatives. The Apple website says it's the best way to experience the web. Some variation of that phrase is repeated several times in the promotional video Apple has released. But it's just not true.

It might be one of the best ways to browse the web on a mobile device, but laptop and desktop computers even netbooks are still better. Most current websites were designed to be experienced on those devices with a mouse and a keyboard. Maybe the mouse isn't necessary, but you don't have to pop up a software keyboard to type in URLs on a netbook or laptop. Even if you lug around the keyboard dock, it will be a tad awkward moving between the keys and the screen to interact. You're sacrificing some usability for simplicity on the iPad.

Most importantly, the iPad's browser does not support Adobe Flash, the foundation of rich media on the web today. Adobe is planning to make it possible for Flash developers to develop apps, but it won't work on the web.

I'll admit that the decision not to support Flash is a logical one if you start at the right premises; Flash is responsible for countless reported crashes on Macs, and Apple can't control it to ensure quality of experience. Apple is banking on a transition to HTML5 and CSS 3 for rich web content. While that transition has already begun, it hasn't fully happened yet. Until it does, it's ridiculous to call this device the best way to experience the web when one of the most ubiquitous and essential web technologies is not supported.

It's an Unprecedented Win for Closed Computing

Many of the software restrictions that drive people mad when they're using the iPhone are going to be just as frustrating on the iPad. All the device's content apps, songs, TV shows, movies, books, you name it can only be processed through Apple's iTunes Store.

You won't be able to drag and drop or share files with other computers like you can with your laptop on your home network. You won't be able to download a program or music file from the web and play it on the spot. You won't be able to use any application that doesn't meet Apple's strict approval guidelines. It's closed computing at its most extreme.

Unfortunately we've come to expect that from our smartphones. For a larger device that's supposed to replace your netbook as a complete portable computing solution, though, this is almost unprecedented at least from a device that's likely to have a great deal of influence on the market and on the design of future devices. That's bad news no matter how you spin it.

It's Not Really a Competitive eReader

The Kindle owns the eReader landscape right now, and the greatest expectation for the iPad was that it would bury the Kindle. While the iPad's reader interface is indisputably sweet-looking and the list of participating publishers is promising, there are several ways it just won't beat the Kindle.

The most important issue is the price. The Kindle costs $260; so do Barnes & Noble's Nook and the comparable Sony Reader. The Kindle even comes bundled with free 3G network access, though it admittedly can't do anywhere near as much with it as the iPad can.

But if you are considering the iPad primarily as a reader, that price difference is a big problem. Also a big problem: The lack of an e-ink display. E-ink doesn't wash your face in eye-strain-inducing light like the displays on the iPhone, the iPad, and laptop computers do. It's meant to be a soft experience, just like reading a book. Without e-ink, you might not be able to tolerate spending four straight hours reading Stephen King's latest on a regular display, cool IPS tech aside.

Finally, as impressive as 10 hours of battery life is for a multi-purpose device like the iPad, the Kindle can run in reading mode for a week without recharging longer if Wi-Fi is disabled. Because it's trying to do everything, the iPad isn't the best at anything.

It's Not Worth It If You Have a Smartphone and Laptop

If the iPad isn't a good option as a middle device, it ought to at least be attractive to power users and enthusiasts who already have other devices. Unfortunately, it's not.

It's not significantly better at anything than either your iPhone or your MacBook. It can't be used as your daily workhorse computer on the go, because just like the iPhone's OS 3.1.2 the iPad's OS 3.2 doesn't multitask. And if you already have an iPhone, you can do basic information gathering, mapping, and so on while you're on the go without spending an additional $29.99 per month for 3G service.

Further, your laptop or netbook very likely has a web cam for video conferencing, and your cell phone probably has a camera (or even video camera) for capturing images. The iPad has neither.

Since the interface is graceful and satisfying, you might want to buy it as an extra device just for the experience, but at between $499 $829, that's not practical for most consumers.

The Anti-Hype

The iPad isn't going to be a phenomenon with either netbook users or power users. It's not better than existing devices at anything, and it's too expensive for most people to use it as a secondary device. I might have said something different if the rumors that the iPad would be all about a new push in the content marketplace were true, but that didn't happen. Instead, we got a cool toy.

The built-in apps are much more Mac-like than iPhone-like, with versions of iPhoto and iTunes that look like touch-oriented versions of their desktop counterparts. There's also some built-in location services that lets the Map app auto-locate, and the iTunes store is built-in for previewing and buying media.

It's a game few are ready to stop playing.

Our little Apple Tablet scavenger hunt has come up mostly empty-handed. Steve Jobs is gonna drop some knowledge on us today, and we're as in the dark (mostly) as we were weeks ago. And you know what? One of the main things we've learned from this little exercise is that the people who are most interested in today's announcement are also the least interested to learn anything in advance.

Here was one of the most fascinating and downright poignant responses our contest elicited, from a reader in India:

I want to make a kind request to you please to call your scavenger hunt off.

We all know why we are so intensely trying to find out the littlest morsel of information about the Apple Tablet and are hardly interested in any other company's slate device - only because Apple will create history with such a device.

I want to emphasize on the fact that Apple puts a lot of effort to building keynotes, which, for many people like myself, are like blockbuster movies. We never had the fortune of being at a live one, so we try to make the best of it being streamed online. Like you remember at the 2007 iPhone keynote, every other moment there was surprise. People had never seen anything quite like it before. And all of it coming from Steve Jobs made it a historical day in technology.

It is my earnest request to you, please let Apple do it again. We all want to know what the Tablet is going to be like. Your bounty offer may (and probably will) instigate people who want to sell their souls. I'm not blaming you or criticizing you. We don't want a few details or pictures to leak out before the official announcement. There's just a few more days left till Jan 27. Please let Steve Jobs introduce it the Apple way. Pretty please. It will be a lot more fun !

Would this guy have clicked through if we had received a real picture? Most definitely. Has he probably clicked on all of the hundreds of mocked up photos and videos? Almost certainly. But the fact that those were fakes was all part of the fun. Sure it's all a bit cynical in its consumerist frenzy, but the Apple's big, heavy-handed reveals are also a good time a bit of mystery, of (imagined) corporate intrigue, of envisioning suddenly-available outer space future products that were previously just the stuff of science fiction classics like Freejack and Demolition Man. (Classics, I tell you!) Remember the iPhone? When ol' Jobsy carted that thing out a few years ago it sufficiently blew most of our brain bones, and wasn't that kind of fun. I mean, rather than knowing all its details ahead of time?

Like blockbuster movies! That's sort of sweet in an irredeemably nerdy way, isn't it? There is something about the grandeur and anticipation of one of these keynote magic shows. Yes it's all nasty and capitalistic and cold and inhuman, but a little bit of excitement never hurt anyone, especially in these penurious times, when a Cosmo centerfold has assumed the regency and rules us all from his throne made of the bones of the New York Yankees.

That doesn't mean every scrap of purported "truth" about Apple's mystery tablet can't drive tons of pageviews (I mean, uniques!). But the real kick of feverish Lost guessing and obsessive Tablet rumoring is the pure joy of speculation with gleeful abandon. Here's the root truth of it all: No one actually wants to be proven right, because then it would all be over and we'd just return to our lives, the answer never actually being as big as we'd hoped, nay, dreamed.

It's a childish thing this entity we call imagination just turned a bit hard and practical by adulthood. No longer do we imagine whole unknown worlds existing in wardrobes or cupboards, but we can be fascinated with the possibilities of that ABC show starring the dude from Party of Five and the potentiality that Penny's computerbook from Inspector Gadget might sort of be real. The minute those youthful fantasies are quelled and quieted by cold hard facts, well... the whole activity loses a bit of its sparkle.

It's the kind of thing the internet can ruin too often. Take another small pleasure: movie previews. Remember movie previews? Oftentimes they were the best part of the whole moviegoing experience. What fresh new hell awaited us come springtime? What joys would poet-scholar John Woo soon be foisting upon us? It was nice to see some new things, things you'd never heard of!, before settling into your seat and getting progressively more bored by your feature presentation. They made movies seem big, eventful, singular. If you wanted to see what was coming up, you had to go sit in the dark and wait for them to show you. But now! Now you've got internet web sites all over the highway that'll show you a teaser sneak trailer for a movie that won't be out until Armistice Day 2014. They've got previews for everything, those internet people. And it ruins all the fun.

Sure it's still sort of exciting when they pop up on the online, but it ruins some of the formality, it just spreads and bleeds the thing out so everyone can see it. Movie previews aren't as controlled and specific anymore. By the time they're up on the flickering screen there, I've already seen them three times over. It's boring, it's vaguely sad to have basically ended this tiny pleasure I enjoyed as a kid. I don't know why I do it to myself. And yet I do.

Though I suppose the whole ruined movie trailers thing isn't the same as a spoiler. A spoiler would be, like... someone telling me about Lost, I guess. Well, I haven't spent five sweaty years emotionally invested in just what the fuck the iTablet or iPad or whatever is all about, but it's still the same giddy joy of anticipation. In the end, what do we get out of either thing? Nothing, really. We're either $700 poorer or we're in six years of emotional debt to friends and family for being unbearably annoying about What Is In the Hatch. But screw it, we gotta take fun where we can get it and I appreciate it not being squashed.

So thank you Apple robot security guards for taking your whirring steel pincer claws and strangling that lab tech who was trying to smuggle an iNewspaper out of the office. That entrepreneurial fellow (he'd have been a hundred-thousandaire!) didn't die in vain. A not-so-well-kept secret is kept so for a few more hours, which will give me (and all of youuu) some dull sort of pleasure in an otherwise bleak and windswept wintry state of the union. Surprises are good almost always better than knowing even when it's about electronic products I don't understand and can't afford. Maybe even especially then.

Here was one of the most fascinating and downright poignant responses our contest elicited, from a reader in India:

I want to make a kind request to you please to call your scavenger hunt off.

We all know why we are so intensely trying to find out the littlest morsel of information about the Apple Tablet and are hardly interested in any other company's slate device - only because Apple will create history with such a device.

I want to emphasize on the fact that Apple puts a lot of effort to building keynotes, which, for many people like myself, are like blockbuster movies. We never had the fortune of being at a live one, so we try to make the best of it being streamed online. Like you remember at the 2007 iPhone keynote, every other moment there was surprise. People had never seen anything quite like it before. And all of it coming from Steve Jobs made it a historical day in technology.

It is my earnest request to you, please let Apple do it again. We all want to know what the Tablet is going to be like. Your bounty offer may (and probably will) instigate people who want to sell their souls. I'm not blaming you or criticizing you. We don't want a few details or pictures to leak out before the official announcement. There's just a few more days left till Jan 27. Please let Steve Jobs introduce it the Apple way. Pretty please. It will be a lot more fun !

Would this guy have clicked through if we had received a real picture? Most definitely. Has he probably clicked on all of the hundreds of mocked up photos and videos? Almost certainly. But the fact that those were fakes was all part of the fun. Sure it's all a bit cynical in its consumerist frenzy, but the Apple's big, heavy-handed reveals are also a good time a bit of mystery, of (imagined) corporate intrigue, of envisioning suddenly-available outer space future products that were previously just the stuff of science fiction classics like Freejack and Demolition Man. (Classics, I tell you!) Remember the iPhone? When ol' Jobsy carted that thing out a few years ago it sufficiently blew most of our brain bones, and wasn't that kind of fun. I mean, rather than knowing all its details ahead of time?

Like blockbuster movies! That's sort of sweet in an irredeemably nerdy way, isn't it? There is something about the grandeur and anticipation of one of these keynote magic shows. Yes it's all nasty and capitalistic and cold and inhuman, but a little bit of excitement never hurt anyone, especially in these penurious times, when a Cosmo centerfold has assumed the regency and rules us all from his throne made of the bones of the New York Yankees.

That doesn't mean every scrap of purported "truth" about Apple's mystery tablet can't drive tons of pageviews (I mean, uniques!). But the real kick of feverish Lost guessing and obsessive Tablet rumoring is the pure joy of speculation with gleeful abandon. Here's the root truth of it all: No one actually wants to be proven right, because then it would all be over and we'd just return to our lives, the answer never actually being as big as we'd hoped, nay, dreamed.

It's a childish thing this entity we call imagination just turned a bit hard and practical by adulthood. No longer do we imagine whole unknown worlds existing in wardrobes or cupboards, but we can be fascinated with the possibilities of that ABC show starring the dude from Party of Five and the potentiality that Penny's computerbook from Inspector Gadget might sort of be real. The minute those youthful fantasies are quelled and quieted by cold hard facts, well... the whole activity loses a bit of its sparkle.

It's the kind of thing the internet can ruin too often. Take another small pleasure: movie previews. Remember movie previews? Oftentimes they were the best part of the whole moviegoing experience. What fresh new hell awaited us come springtime? What joys would poet-scholar John Woo soon be foisting upon us? It was nice to see some new things, things you'd never heard of!, before settling into your seat and getting progressively more bored by your feature presentation. They made movies seem big, eventful, singular. If you wanted to see what was coming up, you had to go sit in the dark and wait for them to show you. But now! Now you've got internet web sites all over the highway that'll show you a teaser sneak trailer for a movie that won't be out until Armistice Day 2014. They've got previews for everything, those internet people. And it ruins all the fun.

Sure it's still sort of exciting when they pop up on the online, but it ruins some of the formality, it just spreads and bleeds the thing out so everyone can see it. Movie previews aren't as controlled and specific anymore. By the time they're up on the flickering screen there, I've already seen them three times over. It's boring, it's vaguely sad to have basically ended this tiny pleasure I enjoyed as a kid. I don't know why I do it to myself. And yet I do.

Though I suppose the whole ruined movie trailers thing isn't the same as a spoiler. A spoiler would be, like... someone telling me about Lost, I guess. Well, I haven't spent five sweaty years emotionally invested in just what the fuck the iTablet or iPad or whatever is all about, but it's still the same giddy joy of anticipation. In the end, what do we get out of either thing? Nothing, really. We're either $700 poorer or we're in six years of emotional debt to friends and family for being unbearably annoying about What Is In the Hatch. But screw it, we gotta take fun where we can get it and I appreciate it not being squashed.

So thank you Apple robot security guards for taking your whirring steel pincer claws and strangling that lab tech who was trying to smuggle an iNewspaper out of the office. That entrepreneurial fellow (he'd have been a hundred-thousandaire!) didn't die in vain. A not-so-well-kept secret is kept so for a few more hours, which will give me (and all of youuu) some dull sort of pleasure in an otherwise bleak and windswept wintry state of the union. Surprises are good almost always better than knowing even when it's about electronic products I don't understand and can't afford. Maybe even especially then.

What would a world be like without the idea of heaven? How would people behave? What would they live for?

Of course, it is not as if the world that we live in, where the notion of an afterlife or some form of continuing existence is prevalent, is all that great. No, there are lots of wars and disagreements in contemporary life. But perhaps we are able to escape a sense of desperation in the belief that modern medicine, prudent behavior, and the possibility of an afterlife will allow us to continue our existence for a while at least, and perhaps permanently.

The ancient, pre-literate Greeks of Homer's day could not so easily apply the balm of eternal life to their troubled psyches. They had no notion of a heaven of the type that Christians believe in, no sense of reincarnation such as the Hindus expect, no Muslim vision of paradise, no anticipation of a reunion with relatives and friends who had predeceased them. Instead, death led to a trip to Hades, the underworld, where existence was a pale and not very attractive shadow of earthly life, not something to be eagerly awaited. So if we want to know how men live when the notion of heaven doesn't exist, we might well look to these people.

Remember too, that the life of the pre-literate Greeks (the Greek alphabet is thought to have come into existence somewhere around 800 B.C.) was painfully short. Even at the turn of the last century, around 1900, the average American lived only about 50 years. The brevity of life was certainly known to the ancient Greeks.

Greek literature and philosophy point to two driving concepts that motivated men. (And I speak of men, because women were extraordinarily disadvantaged in that period, seen as having almost no function or status other than for sex, companionship, rearing children, and domestic handicrafts). Honor and glory were what men sought. Honor tended to come in the form of goods, precious metal, slaves, concubines, and the like; in other words, mostly material things or things that could be counted or displayed or used. Sort of like today, perhaps you are saying to yourself. In our world, honor is conferred by status and very similar material thingsthe size of your house, the amount of money in your bank account, a trophy spouse, the car or cars you drive, a gorgeous vacation home, etc.

Glory (the Greek word kleos) is another matter. What might glory have consisted of in a world without heaven? It took the form of a reputation or fame that continued beyond death. And, since there was no written word, you and your accomplishments had to be sufficiently great to generate discussion, song, and story once you were gone. This was usually achieved by being a great hero or warrior. In war, then, one could hope to grasp both of these things: the honor that came with sacking cities and accumulating wealth, slaves, and sexual partners; and the glory of having the fearlessness, strength, and tenacity to carry out that accumulation via battle; sufficiently so that people would (sometimes literally) sing your praises after you were dead.

As I mentioned, today's world doesn't strike me as much different from yesterday's on the point of achieving honor, although we are a little more discreet about our sexual conquests and have largely risen above keeping slaves. On the subject of glory, however, we seem to do everything we can to avoid death, which in the ancient Greek world was the only path to glory; a path that required both risking one's own death on the battle field and inflicting it on others in the same place. So, whether you believe in heaven or not, it would seem that the idea of heaven has had some civilizing effect. There are, after all, more ways of getting to heaven in our cosmology than killing people, despite what some terrorist/martyrs might tell us.

To me, even apart from the question of a civilizing effect of a particular religious concept, is the human need to conquer death as revealed in the heritage that the pre-literate Greeks have bequeathed us and, of course, in our own religious behavior. Both the ancient Greeks and most of us seem to hope that when we breathe our last, we are not finished forever. It is not a new idea, even if our solutions to the dilemma of mortality are (in part) different from those of our ancestors.

Unless, of course, you are such a brave soul that you have dispensed with the idea that you will live on in any form much beyond the time of your earthly demise: not in words or writings, not in great buildings that bear your name, not in photos or videos, not in businesses that survive you, not in the students you have taught, not in your artistic creations or inventions, not in making the world a better place for those that succeed you; not in the biological output of children, grandchildren, and great-grandchildren who continue your genetic line.

Clearly, it is pretty hard to give up the idea of glory, some sort of posteritythe hope for an afterlifeisn't it?

5. Sprint Overdrive

This is MiFi on steroids with 3G and 4G coverage. This beast is ready today. However, it is limited to certain cities and metro areas in the states. See if you're on the list and if you are, drop that cable company or DSL provider like they're hot.

4. MSI Android slate

This was the closest I found to a slate that was responsive and accurate even for a dude with fat fingers. Maybe the others aren't up to production mode yet but they lacked the same experience, until the MSI would freeze.

3. Vizio wifi TV's

This iteration of 3D is a huge fail. Like bad movies this should have seen limited release or straight to DVD, if you know what I mean. They've embraced almost every type of TV widget that can be made and I would expect to see some brilliant hacks coming our way.

There isn't a whole lot to say that I haven't said already. This is going to be a great, usable device that I wish was running Mac OS. I used a Toshiba tablet PC back in 2006 for my job and loved it. This size would be incredibly useful and mobile.

I wanted to be a Martian Citizen, so I set up an account. The first question was quick and easy: How old are you? Then they asked me to create a Martian Identity. I entered the relevant information in green text. I claimed to be an Intrepid Explorer. And I chose a kangaroo avatar to represent me. And most importantly, I gave my Citizen Oath. I counted the number of craters on-screen by clicking my mouse on each one. The more I played, the more game points I earned. And the act of counting craters will help scientists figure out the age of certain regions on Mars. Was counting craters really as fun as the wildly, addicting game, Minesweeper?

There are multiple levels of engagement through virtual town hall discussions and videos that put Mars researchers in the limelight. But it's not all fun and games. You really do have a chance to help scientists improve the maps, which will help them see the surface changes better. Developers can win a prize if they can figure out how to distribute hundreds of thousands of Mars images online and in the classroom.

Is this my generation's virtual version of the moon landing? There are no strings attached with this visit. NASA gives you the option to just look around with their Anonymous Tourist Visa.

hubbageThe gadgets are flowing and they've got both publishers and subscribers in a tizzy over their options. Are they 3g? Can I put my content on it? Just wifi? What services do they deliver? Do I need to build an app? Am I locked in?

All great questions but not the one that is at the front of my mind. That question being where is the personal media hub for all of this content? Each type of media that we consume has a disparative quality of some sort that requires another gadget or format transcoder to allow usage which means, users need a hub.

I just want to know where that hub will be. I'm not sure if it belongs in the cloud or can even exist there due to limitations placed on that content by rights holders. Which is a legitimate reason not to use the cloud since publishers need to eat.

A couple reasons to use the cloud would be transfer speeds, remote accessibility and backups. With increased gadget connectivity it would make sense to do this. An example of a gadget that needs to be fed from an outside source like the cloud is the PSPgo. It relies on connectivity to fetch games, video and browse the web.

The games on PSPgo arrive from a Sony controlled hub behind a firewall. If the cloud is too limiting due to rights management the other other solution would be to offer a private hub. Another gadget, but one that resides in the dwelling of an individual. Using the Sony model for control and privacy a device like this could be the next evolution of an inclusive hub. It seems to me to be the missing link.

Media management across multiples platforms and for varying devices would require some version of a standard protocol. The protocol probably already exists and could be as simple as HTTP with SSL. The device itself a web server that connects to cars, phones, tablets, computers, televisions, etc.

A device like this could also create new opportunities for rights holders to create new models for selling content. I'm thinking in the range of micropayments for ongoing usage or payments for amount of time used. An example would be a movie that instead of a 24 hour limit would allow the consumer to view it 2 times on any device before being crippled or offered for purchase for an additional few dollars.

My personal interest would be to have a media hub that I had control over and could add content to from any device like the PSPgo, Kindle, iPhone or computer. The ability for these devices to speak a common language for file storage and retrieval would increase consumption and sales as all of a users purchases become portable, even if lockedin to a device.

There are plenty of media hubs that exist today for personal use that can be net connected, but this device would find its niche in storing and delivering content without limitation.

hubbageThe gadgets are flowing and they've got both publishers and subscribers in a tizzy over their options. Are they 3g? Can I put my content on it? Just wifi? What services do they deliver? Do I need to build an app? Am I locked in?

All great questions but not the one that is at the front of my mind. That question being where is the personal media hub for all of this content? Each type of media that we consume has a disparative quality of some sort that requires another gadget or format transcoder to allow usage which means, users need a hub.

I just want to know where that hub will be. I'm not sure if it belongs in the cloud or can even exist there due to limitations placed on that content by rights holders. Which is a legitimate reason not to use the cloud since publishers need to eat.

A couple reasons to use the cloud would be transfer speeds, remote accessibility and backups. With increased gadget connectivity it would make sense to do this. An example of a gadget that needs to be fed from an outside source like the cloud is the PSPgo. It relies on connectivity to fetch games, video and browse the web.

The games on PSPgo arrive from a Sony controlled hub behind a firewall. If the cloud is too limiting due to rights management the other other solution would be to offer a private hub. Another gadget, but one that resides in the dwelling of an individual. Using the Sony model for control and privacy a device like this could be the next evolution of an inclusive hub. It seems to me to be the missing link.

With the imminent release of the Motorola Droid I am more excited about mobile media production than I have been for nearly two years. Sure, I rock the iPhone but have you ever tried to do work on one?

What you see above was my solution about 18 months ago to subvert my dependence on using my iPhone to create and deliver media to the internet without having to take my computer with me or find wifi.

This solution worked great. From left to right is the MicroSD card, MS Pro Duo adapter, SD adapter, USB stick that holds all 3 and a Verizon SMT 5800 with slide out QWERTY. The Verizon phone was able to handle the 8GB MicroSD card like a champ and access any media that placed on it. Since the phone was running WM I could actually work on documents without having to get a third party app. I digress.

I was able to take this posse of electronic goodies with me in my pocket and 10 megapixel camera in my hand to get great shots and put them up on Flickr. Sure it would be easier if the camera on the phone was higher quality but it wasn't an option then and still isn't today in a design that lends itself to mobile media production of all types.

Images and videos need context . . . that context comes from metadata beyond geo location, timestamp or anything else beyond EXIF data. The ability to enter that efficiently with a slide out QWERTY is unmatched by touch devices.

I have gadget crush on the Droid and I've never even put my hands on one. The biggest reason is that I want to be able to have the control over what type of media I am able to produce when on the go without much restriction. The ability to replicate the solution at the top of this post with a device that also shoots video and has a 5 mp camera with flash is exciting.

If I were building a startup today I would be looking at aggregating all of this mobile media in a clean interface and partnering with as many carriers and mobile blogging sites. As these devices hit the street and more newbs hook it up with simply what's on deck there will tons of filtering that needs to be done to make it useful.

What is your ideal mobile media maker arsenal? Keep in mind that it must have ability to get your content online.

summer_of_codeI saw into the future. At 10:00 AM PDT on October 25th, in a conference room seating 16 people at the Googleplex in Santa Clara, I saw into the future of the web. And it was good.

What I saw was the demise of Web 2.0, a technology grown to capacity. And it is not Web 3.0 (whatever that is) that will take its place. No, tomorrow's web is about user interfaces.

The weekend of October 24th was the annual Google Summer of Code (GSOC) Mentor Summit at Google's headquarters. Ostensibly, this is the opportunity for all of the Open Source organizations who participated in GSOC to get together and perform a collective postmortem on the summer's successes and failures. But anytime such a menagerie of geeks is assembled under one roof, much more is bound to happen.

Unsurprisingly, many of the unconference's sessions were focused on the GSOC program itself. But a healthy dose of technology centered sessions made their way onto the schedule as well, and the hallway may very well have seen more code than the conference rooms.

Beyond the physical conference space, much was happening in the virtual sphere as well. As a gesture of thanks to the GSOC participants and mentors for a summer of work, Google gave everyone Wave accounts.

Wave's utility lies in numbers. Signing in without a friend is like throwing a party but inviting nobody. Bring a friend or two into the Wave, and it feels like hosting tea in a room with too much furniture. But once the numbers start to rise, Wave's strengths surface. It is a cocktail party that comes complete with a birds-eye view of all of the chit-chat. Conversations swirl around, splintering into smaller threads of conversation only to merge back into the main discussion later. Images, maps, polls, and an API for building extensions make Wave a promising tool except for one thing.

The user interface stinks.

Yes, Wave's merits surface only when many people are in a discussion. Unfortunately, that's also where the big shortcomings surface. As one conversation forks into many smaller discussions, the wave quickly becomes visually unmanageable. The Quickest Scrollwheel in the West will still have a hard time traversing the continuously growing vertical pane that wraps the conversation. The entire advantage gained by the birds eye view of the conversation is lost to clumsy scrolling.

But this failing is indicative of something greater. Once again, Google has achieved an engineering masterpiece. And for all technical purposes, Wave is a marvel. It certainly pushes AJAX and asynchronous web interaction to its very limits, and I have no doubt that the source code for the server component would make my head swim. But the user interface, for all its visual business, simply doesn't work. Wave is an attempt to cram the internals of a Hummer into the body of a circa 1996 Honda Civic.

This is where the Mentor Summit offered a revelation.

On the second day of the summit, the PyMT team hosted an hour-long session on multi-touch input. PyMT is a set of Python application bindings for various multi-touch libraries. Linux, Windows, and OS X all support multi-touch input technologies. Last week, Apple's new Magic Mouse made its debut featuring a multi-touch surface atop a traditional laser-based mouse. Dell offers a laptop with a multi-touch screen. Wacom offers a multi-touch tablet. Microsoft's Surface technology boasts table-sized multi-touch surfaces.

Multi-touch is arriving in a big way. But what's the hubub about? What's the big feature that suddenly makes these technologies attractive? It is the extension of point and click to touch, tap, pinch, swipe, expand, drag, rotate, throw. The simple mouse model that has driven graphical interaction for decades is mid-way through an extreme makeover. And with deflection- and pressure-sensing surfaces rapidly advancing, mice and fingers are just the tip of the input iceberg.

The PyMT team took an hour-long trip to Google's hands-on room and came back with an impressive demonstration. Beginning with some Lego pieces, a flat sheet of metal, and a PlayStation 3 camera, the pair of programmers from PyMT built a gaming surface and a couple of paddles. The camera tracked the motion of the paddles on the surface, transforming the physical paddles into virtual ones in a game of Pong projected onto the wall. In an hour!

When we can build new input devices with an Open Source library and $35 worth of corner-drug-store toys, a whole new universe of possibilities appears.

And that's where Wave returns to mind. As I walked out of the room with UX Design guru Steve Fisher, he turned to me an remarked, When I watch a demo like this, it makes me wonder What is the Web going to look like in a few years. Yeah, it makes me wonder, too.

Wave is a fantastic architecture. But the architectural gems are obscured behind yesterday's user interface limitations. In that way, Wave is a milestone that marks the death of Web 2.0. And it is more than that. It's a fingerpost pointing not to the technologies touted as Web 3.0, but toward a new mode of human-computer interaction. What is going to make tomorrow's web compelling? Not metadata. Not cleaner layout. Not even native support for videos. Better user interfaces. Interfaces tuned to convey information more effectively. Reactive interfaces. That's where tomorrow's success stories are waiting.

HTML 5 and RDFa are good and all, but the real sea-change is coming from your fingertips. All ten of them.

A little over a month ago, we reviewed the NPR News iPhone App. We raved about its radio integration and personalization options, so much that we definitively declared that NPR's iPhone app blows other news apps out of the water.

We may have spoken too soon, because that declaration was before the CNN iPhone App.

The CNN iPhone App, which is now live in the app store [iTunes link], is nothing short of impressive. It combines breaking news with customization, the ability to save stories, streaming video whenever breaking news is in progress, and most intriguing of all, citizen journalism.

CNN's iPhone App: It's Impressive

The CNN iPhone app is divided into four key (but very different) components, combining for one seamless app experience. Here's what you can expect if you download the $1.99 app:

Headlines: It's the core of any news app being able to read breaking news. You can sift through news by recency and by category (crime, politics, health, etc). And since it's CNN, you can also share stories via Facebook Connect, Twitter, SMS, and email.

Oh, one more cool thing about headlines: if you turn your iPhone on the side, you can view stories like you can your iPod album covers. Flick through images to find the story that interests you. It's a uniquely visual way to consume news.

My CNN: The app is chock-full of personalization options. Our favorite is the ability to save stories you want to read later. You don't even need a connection to read saved stories, so you pick out the news you want and read it on the plane without a problem.

Another nifty feature: you can follow topics or stories that interest you and get alerts when there are updates to that story.


Video: Yeah, this app gets even better. It is CNN we're talking about, so you'd hope there would be some video. You can watch on-demand clips related to breaking news. However, we're huge fans of the live streaming video integration. Anytime there's a breaking event (Obama gives a speech, a major natural disaster, election night, etc.), live coverage from CNN Live becomes available. Hell, this is a feature that I'd purchase as a standalone app itself.

iReport: Out of all of the CNN iPhone App's features, this one may be the most game-changing. iReport is CNN's user-generated citizen journalism initiative, where everyday citizens can upload photos, videos, and stories about events happening near them. Some of it is even used on CNN's news coverage.

Guess what? The app lets you submit photos and videos you take with your iPhone to iReport and to CNN. Can you imagine how much citizen journalism this app will encourage?

To say we're impressed with this app is an understatement. CNN went all-out with features and functionality, but did it in a way that's simple and easy to use and consume. The app sets a new standard in functionality and even has the potential to change the news game with its iReport integration. It's the complete package.

Beverly Stayart searched her own name and didn't like the results. She got links to pornographic websites, online pharmacies promoting sexual dysfunction drugs, and an adult-oriented online dating service. She sued Yahoo! and other defendants, including the operator of AdultFriendFinder, for false endorsement under the Lanham Act and state-law privacy violations. The court dismissed the Lanham Act claim and surrendered jurisdiction over the state law claims.

Stayart lives in Wisconsin and was previously employed by several major financial institutions in Chicago, attaining the position of Vice President. She's involved in animal protection and genealogy research throughout the world. This includes an internet presence; her periodic posts on one genealogical website have generated almost 17,000 hits during the past three years. (Okay, I'm sorry, but: on the internet as a whole, that's tiny. My stats look more impressive than thatif you've never seen any others.) And two of her poems appear on two Danish websites (they support the preservation of baby seals).

Stayart alleged that she was the only Beverly/Bev Stayart on the internet, and that she had never engaged in a promiscuous lifestyle, or other overt sexual activities, which are repugnant to her and her community. She alleged that her name had commercial value because of her humanitarian endeavors, positive and wholesome image, and the popularity of her scholarly posts on the Internet. The search engine defendants, she alleged, knowingly used her name on false snippets in results by (1) repeatedly linking Plaintiff to the advertising of Cialis by an online pharmacy; (2) repeatedly linking Plaintiff to six separate websites playing pornographic videos containing computer spy ware; and (3) repeatedly linking Plaintiff to a website captioned Free Streaming Porn--HOTTEST DAILY PORN' displaying 27 hardcore pornographic photos. She asked Yahoo! to stop linking her name to these search results. Yahoo! replied: We do not aim to judge web content for appropriateness or censor materials that we find offensive or inappropriate. Instead, we present information as it is reflected on the Web, allowing you to draw your own informed conclusions about what you see.

Stayart also alleged that Various (which operates AdultFriendFinder) used her name on a website advertising its service. She typed her name into altavista.com and got, among the results, jewellery-makin-doorway.orge.pl/bev-stayart.html. This went to an Under Construction site that stated Meet AdultFriendFinder members near Janesville [Wisconsin]-- Over 20 Million Members and displayed five graphic images of fully or partially nude women, accompanied by the age, nickname and city of residence of the women.

Under Iqbal, though a court must accept all well-pleaded facts as true, the claim must still have facial plausibility. And a plaintiff can plead herself out of court, which was what the court determined had occurred here.

False endorsement means that consumers are likely to be misled about a person's sponsorship or approval of a product or service.

In order to have prudential standing under the Lanham Act, Stayart needed to allege at least an existing intent to commercialize her identity. This she didn't do. Though she alleged that her name has commercial value, her complaint is really about distasteful associations. That emotional desire to prevent others from using her name doesn't create Lanham Act standing. Her correspondence with Yahoo!, attached to the complaint, further indicates that her concerns are with privacy and reputation, defamation and demeaning associations. But the Lanham Act does not create a false light tort claim, absent commercialization.

Stayart relied on Doe v. Friendfinder, which refused to dismiss a false endorsement claim against AdultFriendFinder. But Doe didn't address prudential standing in its decision.

The court went on to reach an independent ground for dismissal, lack of likely confusion as a matter of law. [A] commonsense reading of the complaint demonstrates that there could be no likelihood of confusion. The complaint explicitly disavows any association with pornographic materials, sexual dysfunction drugs, or sexually-oriented dating services. This contravenes likelihood of confusion, so Stayart pleaded herself out of court. (Query: before 1999, would Bob Dole have had a claim? He'd never previously been associated with sexual dysfunction drugs, so wouldn't it have been just as implausible that he'd be a pitchman for them?) No one who accessed these links could reasonably conclude that Bev Stayart endorsed the products at issue.

Stayart argued initial interest confusion against AdultFriendFinder. But on the internet, initial interest confusion depends on relatedness of goods and a consumer's level of care. Given that Stayart's identity is completely unrelated to AdultFriendFinder's services, initial confusion won't facilitate free riding on another mark's goodwill. Without a meaningful effect on the market, confusion is of little or no consequence under the Lanham Act. The type of person looking for information about Bev Stayart would not be fooled into using an online adult-oriented dating website. (I'd add in to find her at the end of that; the court might be surprised to find outjust as Stayart might bethe non-Stayart-related interests of the type of people looking for information about Stayart. I'd be willing to bet that even genealogists and animal rescuers sometimes like to meet adult friends!)

Next, a puzzling CDA discussion. The court commented that if Stayart successfully stated a false endorsement claim under the Lanham Act, it would probably fall under the CDA's intellectual property exclusion. But, it continued, one of the fatal flaws of that claim is that Yahoo! didn't use Stayart's name in connection with its own goods or services. It just included snippets from third-party websites and didn't create the content of which Stayart complained. So the proper analysis is vicarious liability/contributory infringement under the Lanham Act.

Under settled doctrine, Yahoo! can't be held liable for failing to remove the search results even after Stayart complained. It didn't control the third-party websites, which fact defeated both contributory and vicarious liability. (That's a shortcut on contributory liability analysis, but not particularly troubling under the circumstances.) The only way Yahoo! could control the results would be to change its algorithm, which goes to the heart of Yahoo!'s role as an interactive computer service. Because ordinary search engines play no part in developing any unlawful searches, Yahoo! should be entitled to immunity because it acted as an interactive computer service, even though Stayart's claims are nominal intellectual property claims. Immunizing Yahoo! doesn't contravene the CDA's IP exclusion because Stayart doesn't have a valid IP claim.

Comment: oh, my. Look, I like CDA immunity generally. But what's weird here is not the court's willingness to use CDA reasoning on an IP claim despite the IP exclusion; what's weird is the court's failure to notice that IP secondary liability doctrine itself incorporates the tech-promoting rationales underlying the CDA. Well, trademark does much more than copyright, these daysbut it's trademark doctrine that's at issue here! There's no need to bring in the CDA! And that last bitthis analysis only applies because Stayart doesn't have a valid IP claimmakes this whole excursion even more obviously useless.

The court then said that matters were less clear with respect to AdultFriendFinder. The site is in some ways interactive, but Stayart's complaint relates to the banner ad associated with the bev-stayart.html URL. AdultFriendFinder's role in the creation of the banner ad content was unclear, so the court couldn't grant it immunity at this stage.

The only claims that remained were state-law claims. Given that the dismissal was on the pleadings, ordinarily a federal court should relinquish jurisdiction, unless it is so obvious how the claims should be decided that the plaintiff should be put out of her misery rather than involving state-court resources. Defendants argued that Wisconsin requires a name to have commercial value in order to maintain a right of publicity claim. But some variations of the appropriation tort, which Wisconsin may recognize, require only commercial use plus bruised feelings. (Doesn't Yahoo! get out of this even if AdultFriendFinder has to proceed in state court? Under what theory is Yahoo!'s use commercial? If it's using snippets from other sites, how can it possibly be distinguished from the New York Times using Stayart's name in a story?)

The distinction between appropriation and the right to publicity (based on commercial damage) is also relevant to CDA immunity. The latter is an IP claim. (Implicit holding: to the extent Stayart is bringing an appropriation claim, Yahoo! is immune.) Plus there's the Perfect 10 versus Friendfinder split over whether state IP claims are preempted by the CDA. Since this is an unsettled issue of federal law, the court couldn't conclude that there was an obvious resolution of the state
