Still, even that may not protect the employees from criminal liability like what occurred in the Google matter.

Now we create a TwitterOAuth object. The class constructor chooses HMAC-SHA1 as the signature method, and builds a OAuthConsumer object with the app consumer key/secret.
$to = new TwitterOAuth($consumer_key, $consumer_secret);

With that object we use curl to request a token from twitter. The API URL we hit is https://twitter.com/oauth/request_token. getRequestToken() pulls the tokens from twitter, parses it into an array, and creates a new OAuthConsumer object.
$tok = $to->getRequestToken();

Save the tokens for when the user returns from Twitter.

Set up the authorization URL. This is the URL the user will visit to tell twitter the application can access their data. https://twitter.com/oauth/authorize is used.
$request_link = $to->getAuthorizeURL($token);

Once the user tells twitter yes and returns we request the access tokens. The access tokens can be thought of the users passwords and will be used to authenticate as them for future API calls. https://twitter.com/oauth/access_token is used.
$tok = $to->getAccessToken();

At this point you can check https://twitter.com/account/connections and the application should be listed.

Build a new TwitterOAuth object using consumer key/secret and access key/secret.

Now to interact with the API as the user to verify their credentials. This should return their profile. You can now save the access key/secret as being associated with the returned user info.

Today, Rescuecom issued a press release declaring victory in its litigation against Google. But it's an odd definition of "victory" given that Rescuecom has apparently voluntarily abandoned its 6 year litigation effort without any new concessions from Google. The dismissal notice.

This development reminds me a lot of the American Blinds v. Google denouement, where American Blinds also simply gave up and dropped its multi-year lawsuit without any concessions from Google. Note to future plaintiffs: if you're going to threaten Google's $20B/year cash cow, chances are pretty good that they have the resources to outlast you.

Why did Rescuecom give up? According to Rescuecom's press release, "Google has recently confirmed to Rescuecom that it has removed Rescuecom's trademark from its Keyword Suggestion Tool." That, plus the fact that Google blocks trademark references in ad copy, means that Rescuecom feels it has "obtained two of the three things we initially sought in our complaint against Google." And if two out of three is good enough for Meat Loaf, apparently it's good enough for Rescuecom. At minimum, having low standards makes it a lot easier to declare victory when you give up.

However, this explanation is pretty hollow. Although the press release treats Google's removal of Rescuecom from the keyword suggestion tool as a new development, it appears that Google made this change IN 2005. Wendy Davis reports:

[Rescuecom CEO] Milman says he only learned last week that Google had stopped suggesting Rescuecom as a keyword. "Who knows what would have happened if they had told us back in 2005 that they had taken our name out of their keyword tool?" he said.

Hmm...I think I know the answer to that question! Then again, if getting out of the keyword suggestion tool really was one of Rescuecom's Big Three objectives all along, maybe they might have asked Google about it in 2005...or 2006...or 2007...or, well, you get the point. Spin it however they want, it's hard for Rescuecom to look good while dropping a lawsuit based on a 5 year old fact.

Nevertheless, I'm interested in knowing more about this removal. Does Google have a way for trademark owners to "opt out" of having their trademarks in its keyword suggestion tool? I would expect that option to become very popular if it were well-known. If anyone has information about how trademark owners can make an election with Google, please share it.

Given the completely disingenuous nature of declaring victory based on getting out of the keyword suggestion tool, there may be a better--and more self-interested reason--for Rescuecom to give up. Rescuecom is defending a trademark lawsuit brought by Best Buy over Rescuecom's competitive AdWords purchases of the "geek squad" trademark. Rescuecom was caught in the duplicitous position of making plaintiff-side arguments against Google while making highly contradictory defense-side arguments against Best Buy. As a result, every positive step in its Google case had the potential to degrade its position in the Best Buy case. By abandoning the Google fight, Rescuecom avoids this difficult dilemma.

As an odd byproduct of this development, Google and Rescuecom are now aligned in advancing the arguments that competitive keyword advertising in AdWords is legitimate. Isn't there a passage in the Bible about the lion and the lamb lying down together?

I was invited to a behind the scenes look at elements of the Windows Phone 7 Series developer platform. At Mobile World Congress (covered earlier in this channel), Microsoft provided a first look at Windows Phone 7 Series and I'm pleased to offer you the opportunity to see a live demonstration up close.

Yes, I got to play with the phone, too. It works as advertised even as a prototype. Unfortunately, we could not adjust the brightness settings in this particular device. The Metro interface is a bucket of win in my book.

Charlie Kindel partner group program manager, Windows Phone App Platform & Developer Experience was hosting an intimate reception this evening in San Francisco. I wasn't able to make it, but Microsoft arranged a somewhat more private meeting with Greg Sullivan from the Windows Phone team a little closer to home.

I met Greg a few years ago through the Longhorn Labs project (back when Microsoft Windows team leads worked actively with their most vocal community supporters). I'm not sure if I can reveal any more device details at this point, but suffice it to say

In other words, we really don't know what Steve has going on under that shiny dome of his, we just hope it's as exciting as he makes it sound.

The carrier's network has been that of the iPhone in the U.S., and perhaps its relationship with Apple played a role in AT&T waiting longer than other carriers to get into the Android game. That is set to be rectified with the carrier's introduction of the Motorola Backflip, an Android-based phone which will be the carrier's first. The first AT&T Backflips are hitting reviewer's hands, and a mind-boggling function of the Google phone has come to light. AT&T has removed Google search from this Android phone, and replaced it with Yahoo search. As noted by engadget:

Yahoo has replaced Google as the default search provider throughout the phone. It's crazy: the home screen widget, the browser, everything's been programmed to use Yahoo.

It is not unusual for carriers to work deals for specific software on its handsets. They take money wherever they can get it. But this deal is sure to confuse the customer, as Android phones are commonly called Google phones by many. Let's face it, Google makes Android, and one of its strengths is the tight integration with the company's online services. And search is certainly one of Google's big services, but not on the AT&T Backflip.

This is the equivalent of a Windows PC hitting the market that has Internet Explorer removed and Safari as the only browser. Some customers might be happy by that but most would be confused. Then to make matter worse, imagine that Internet Explorer couldn't be installed by the user to get around this major change. That seems to be the case with the AT&T Backflip, as early testers are reporting the inability to get Google search working in any of the Android programs.

There could be no clearer example of fair use -- but the video was still taken down. There was some dispute at the time as to whether or not this was an actual DMCA takedown, or merely YouTube's audio/video fingerprinting technology (which the entertainment industry insists can understand fair use and not block it). But, in the end, does it really make a difference? A takedown over copyright is a takedown over copyright.

Amazingly enough, it appears that almost the exact same thing has happened again. A video of one of Lessig's presentations, that he just posted -- a "chat" he had done for the OpenVideoAlliance a week or so ago, about open culture and fair use, has received notice that it has been silenced. It hasn't been taken down entirely -- but the entire audio track from the 42 minute video is completely gone. All of it. In the comments, some say there's a notification somewhere that the audio has been disabled because of "an audio track that has not been authorized by WMG" (Warner Music Group) -- which would be the same company whose copyright caused the issue a year ago -- but I haven't seen or heard that particular message anywhere.

However, Lessig is now required to fill out a counternotice challenging the takedown -- while silencing his video in the meantime:
While you can still see the video on YouTube, without the audio, it's pretty much worthless. Thankfully, the actual video is available elsewhere, where you can both hear and see it. But, really, the fact that Lessig has had two separate videos -- both of which clearly are fair use -- get neutered due to bogus copyright infringement risks suggests a serious problem. I'm guessing that, once again, this video was likely caught by the fingerprinting, rather than a direct claim by Warner Music. In fact, the issue may be the identical one, as I believe the problem last year was the muppets theme, which very very briefly appears in this video (again) as an example of fair use in action. But it was Warner Music and others like it that demanded Google put such a fingerprinting tool in place (and such companies are still talking about requiring such tools under the law). And yet, this seems to show just how problematic such rules are.

Even worse, this highlights just how amazingly problematic things get when you put secondary liability on companies like Google. Under such a regime, Google would of course disable such a video, to avoid its own liability. The idea that Google can easily tell what is infringing and what is not is proven ridiculous when something like this is pulled off-line (or just silenced). When a video about fair use itself is pulled down for a bogus copyright infringement it proves the point. The unintended consequences of asking tool providers to judge what is and what is not copyright infringement leads to tremendous problems with companies shooting first and asking questions later. They are silencing speech, on the threat that it might infringe on copyright.

This is backwards.

We live in a country that is supposed to cherish free speech, not stifle it in case it harms the business model of a company. We live in a country that is supposed to encourage the free expression of ideas -- not lock it up and take it down because one company doesn't know how to adapt its business model. We should never be silencing videos because they might infringe on copyright.

Situations like this demonstrate the dangerous unintended consequences of secondary liability. At least with Lessig, you have someone who knows what happened, and knows how to file a counternotice -- though, who knows how long it will take for this situation to be corrected. But for many, many, many other people, they are simply silenced. Silenced because of industry efforts to turn copyright law into something it was never intended to be: a tool to silence the wider audience in favor of a few large companies.

The system is broken. When even the calls to fix the system are silenced by copyright claims, isn't it time that we fixed the system?

6 Free Android Apps That Will Make You Drop Your iPhone

Android vs iPhone imageThe Android Market may still lag behind the iPhone App Store in terms of variety and quality, but there is something to be said for the Android operating system's extremely tight integration with existing Google products, and the wide choice of devices and carriers.

There's no question that the iPhone has many wonderful apps, but Android's smart syncing with existing tools, interesting Android-only experiments coming every day from Google employees, and its open marketplace model have yielded some tools that may give the average iPhone user pause.

If you're looking for a change, or you're in the smartphone market and still weighing the pros and cons, consider these Android-only apps and how they might fit into your work, play, and mobile lifestyle.

1. OpenHome

OpenHome Image

There's no denying that the iPhone OS is a gorgeous piece software. But when it comes to the home screen, you get what you get, and you don't get upset, to quote a nursery school mantra.

Android is completely open-source, which means that apps can change the functionality and appearance of the OS, if you permit them to. This isn't always good for safety, but it's great for customization.

OpenHome is one of the leading customization apps available on the Market. It functions as a replacement for the default home screen, into which you can load customs skins, icon packs, and fonts many of which are freely available in the Market and created by other users.

In addition to the look and feel of your OS, OpenHome also allows for other custom tweaks including soft keyboard improvements and widget modifications.

2. Google Voice

Imagine a world where you never have to listen to another voicemail again. That's almost what you get when you set up Google Voice and utilize the Android app. Google Voice lets you keep your existing mobile number, but will forward your missed calls to a generated Google number that you can check on the web, in your e-mail, or via the app.

The service automatically generates voicemail transcription that is usually accurate enough to get the gist of what the caller is saying. Instead of getting a voicemail on your phone, you'll receive and e-mail (or text message) with the transcription.

The app then lets you scroll through your messages visually, like an e-mail inbox, and stream the audio messages from the web as needed, all without wasting precious mobile minutes.

There are certainly other great voicemail alternatives for the iPhone (and Voice is available as a web-based service), but Google Voice's deep integration with Gmail (you can also enable audio playback within web e-mail messages) makes it a great compliment to your hand-held arsenal of communications tools.

Google Voice is still an invite-only service at the moment. You can request an invite from Google here, or hit up your friends on social networks for one.

3. NESoid

Classic gamers rejoice! NESoid is a Nintendo ROM emulator for Android that actually works. The app itself is software that interprets ROM files the format of choice for hacked console games. Assuming you're loading a worthwhile ROM file from your SD card, the gameplay is really smooth.

The lite version of NESoid is free, but prevents you from loading a saved-state of a game. The full version will cost you $3.49 and unlocks this feature.

Most ROMS are not exactly kosher in terms of copyright, so we'll leave it at your discretion whether you want to actually track down the games. This is likely why console emulators have not made it through the stringent App Store approval process, but are now appearing in Android's more liberal Market.

6 Free Android Apps That Will Make You Drop Your iPhone

Android vs iPhone imageThe Android Market may still lag behind the iPhone App Store in terms of variety and quality, but there is something to be said for the Android operating system's extremely tight integration with existing Google products, and the wide choice of devices and carriers.

There's no question that the iPhone has many wonderful apps, but Android's smart syncing with existing tools, interesting Android-only experiments coming every day from Google employees, and its open marketplace model have yielded some tools that may give the average iPhone user pause.

If you're looking for a change, or you're in the smartphone market and still weighing the pros and cons, consider these Android-only apps and how they might fit into your work, play, and mobile lifestyle.

1. OpenHome

There's no denying that the iPhone OS is a gorgeous piece software. But when it comes to the home screen, you get what you get, and you don't get upset, to quote a nursery school mantra.

Android is completely open-source, which means that apps can change the functionality and appearance of the OS, if you permit them to. This isn't always good for safety, but it's great for customization.

OpenHome is one of the leading customization apps available on the Market. It functions as a replacement for the default home screen, into which you can load customs skins, icon packs, and fonts many of which are freely available in the Market and created by other users.

In addition to the look and feel of your OS, OpenHome also allows for other custom tweaks including soft keyboard improvements and widget modifications.

2. Google Voice

Imagine a world where you never have to listen to another voicemail again. That's almost what you get when you set up Google Voice and utilize the Android app. Google Voice lets you keep your existing mobile number, but will forward your missed calls to a generated Google number that you can check on the web, in your e-mail, or via the app.

The service automatically generates voicemail transcription that is usually accurate enough to get the gist of what the caller is saying. Instead of getting a voicemail on your phone, you'll receive and e-mail (or text message) with the transcription.

The app then lets you scroll through your messages visually, like an e-mail inbox, and stream the audio messages from the web as needed, all without wasting precious mobile minutes.

There are certainly other great voicemail alternatives for the iPhone (and Voice is available as a web-based service), but Google Voice's deep integration with Gmail (you can also enable audio playback within web e-mail messages) makes it a great compliment to your hand-held arsenal of communications tools.

Google Voice is still an invite-only service at the moment. You can request an invite from Google here, or hit up your friends on social networks for one.

3. NESoid

Classic gamers rejoice! NESoid is a Nintendo ROM emulator for Android that actually works. The app itself is software that interprets ROM files the format of choice for hacked console games. Assuming you're loading a worthwhile ROM file from your SD card, the gameplay is really smooth.

The lite version of NESoid is free, but prevents you from loading a saved-state of a game. The full version will cost you $3.49 and unlocks this feature.

Most ROMS are not exactly kosher in terms of copyright, so we'll leave it at your discretion whether you want to actually track down the games. This is likely why console emulators have not made it through the stringent App Store approval process, but are now appearing in Android's more liberal Market.

Scherillo v. Dun & Bradstreet, Inc., 2010 WL 537805 (E.D.N.Y. Feb. 17, 2010)

I teach my Cyberspace Law students that the most effective online contract formation process is a "mandatory non-leaky clickthrough agreement":

* mandatory = the user cannot proceed to the destination without going through a screen soliciting their consent to the user agreement.
* non-leaky = there are no alternative ways the user can reach the destination. I realize this is redundant with "mandatory," but I remind students that a seemingly mandatory process can have leaks. For example, if customer support representatives will manually set up user accounts occasionally, the mandatory online process has become leaky because now a few users reached the destination without consenting to the agreement.
* clickthrough = the user manifests assent to the contract by clicking, and the user is told that the click signifies assent.

There are other ways to form online contracts (e.g., email exchanges), but if executed properly, the mandatory non-leaky clickthrough process should do very well against contract formation challenges. But even this description leaves open a number of user interaction judgments. Does likelihood of contract formation vary if:

* the agreement terms are presented on the clickthrough page itself or are only available for review by hyperlink?
* the agreement terms are presented in a scrollbox? If a scrollbox is used, must the user be forced to scroll through the scrollbox?
* the user is asked to check an additional box, such as a certification that the user has read the agreement?

In all of these cases, I believe the contract should be properly formed whether the answer to these questions is yes or no. However, I'm now a fan of adding a bonus mandatory checkbox as part of the formation process after reading today's opinion. A user mounts a sophisticated challenge to a mandatory non-leaky clickthrough process, and the bonus mandatory checkbox helps squelch the challenge. I think the court would have enforced it without the checkbox, but it sure put the user in an awkward/untenable position.

Scherillo bought a financial report about a company from Dun & Bradstreet's Small Business Solutions website. Scherillo alleges that the report painted an overly rosy picture of the company, leading him to make bad investment decisions that cost him money when the company tanked. Scherillo wants D&B to cover his investment losses.

Scherillo is almost certain to lose on the merits. Indeed, this case brought to mind one of the earliest cyberlaw cases, Daniel v. Dow Jones, 520 N.Y.S. 2d 334 (N.Y.C. Civ. Ct. Spec. Term 1987). (This case is a fun read--see how the court discusses electronic networked communications almost a quarter-century ago). That case involved Dow Jones' publication of an ambiguous report via a dial-up online service that led the plaintiff to make a bad investment decision. The court said that any tort claim for publishing inaccurate information required the plaintiff to show that it had a "special relationship" (analogous to a fiduciary relationship) with the information vendor, and an ordinary customer-vendor relationship did not qualify as a special relationship.

Interestingly, D&B would rather hear the case in NJ rather than keep it in NY and hope to benefit from substantive NY law that surely would doom Scherillo's case. (Perhaps NJ has a similar law). To move the case to NJ, D&B invoked the venue selection clause in its user agreement. Let's look at the online contract formation process. The court says:

"since 2007, the SBS website has included a page that requires users to register before purchasing a Dun and Bradstreet product ("the registration page"). On the registration page, users input information, including their e-mail address and name. The bottom quarter to third of the page contains a scrollable text box with the title "Terms and Conditions" [which contained a mandatory venue selection clause designating NJ]. Directly below this text box there is more text that reads: "I have read and AGREE to the terms and conditions shown above." Immediately adjacent to this text is a much smaller, empty box ("the terms and conditions check box"). Also at the bottom of the page is another box containing the phrase "Complete Registration" ("the Complete Registration box"). Clicking on this box completes the user's registration. McDonald testified that if a user clicks on the Complete Registration box without checking the terms and conditions check box, the user is unable to complete registration and is returned to the registration page."

Check out the page yourself as I saw it in Google Chrome on Feb. 18 (with cropping). The formation process looks pretty standard to me.

Scherillo attacked the formation process by saying he never consented to the agreement because "it was possible for him to unknowingly and involuntarily 'check' the terms and conditions check box." Not only that, he lined up Sean Chumura, "a cyberwarfare and computer forensics expert" who is also [LINK NSFW] helping Perfect 10 in its lawsuit against Google, to testify that "it was possible for plaintiff, while 'tabbing' through the registration page, to inadvertently hit the space bar and thereby 'check' the terms and conditions box."

[Snarky paragraph alert] First, this may prove the adage that you can find an expert to testify about ANYTHING. Second, Scherillo alleged $75k of investment losses. For a low-value lawsuit like that, he needs a cyberwarfare expert??? Third, I believe Chumura has a MySpace page. Really...? I wonder if he uses an AOL.com email address too. The MySpace page also reveals that its author appeared to attend the Dan Quayle school of spelling.

OK, back to the case. The judge was no more tolerant of this nonsense than I am. He resolves the factual dispute by saying:

even under plaintiff's theory--that, while "tabbing" through the fields on the registration page, he accidentally hit the space bar key and thereby "checked" the terms and conditions box--plaintiff would have seen the check mark appear in the box and then still would have had to hit the "return" key (or clicked the "complete registration" box with the mouse) to complete the registration and advance to the next screen. Plaintiff would have had an opportunity to see that he checked the box inadvertently before he then hit the return key on the "complete registration" box. Thus, to accept plaintiff's theory, the Court would have to find that plaintiff hit two keys accidentally-the space bar and the return key-and that he was then involuntarily and unexpectedly sent to the next screen where he nonetheless proceeded to enter his credit card information and complete the purchase of the report. This alleged chain of events is simply not credible.

Therefore, Scherillo's click on the "Complete Registration" box manifested Scherillo's assent to the terms, even if Scherillo chose not to review them. The court says that the fact that the terms were in a scrollbox is immaterial, and the fact that some sites require the user to scroll through the scrollbox before proceeding doesn't affect the effectiveness of D&B's implementation.

I believe this court would have upheld the formation process even without the bonus checkbox, but you can see how the checkbox defused the withering assault of a cyberwarfare expert. Thus, you might consider implementing the bonus checkbox to discourage similar silly attacks against your contract formation process in the future.

As expected, HTC has unleashed a slew of Android smartphones here at the Mobile World Congress in Barcelona, and I have to admit they're looking really good.

While not exactly groundbreaking, HTC Desire is the top-notch phone that competes primarily with Google's Nexus One (also made by HTC), as it has similar looks and pretty much the same specifications.

Here's a quick overview: It's an Android 2.1 phone with a 1 GHz Snapdragon CPU, 512MB or ROM and 576 MB of RAM memory, a 5 megapixel camera (with flash and autofocus), GPS, and the usual connectivity options: Wi-Fi, Bluetooth, 3G. It also has a beautiful AMOLED 3.7 inch screen (multi-touch is supported) with 480800 pixel resolution.

What makes it different from the Nexus One is the lack of trackball, and HTC's Sense UI, so the choice between the two will be strictly a matter of personal preference. I will update this post with some hands-on experiences as soon as I lay my hands on it.

*Update: After trying out the HTC Desire, I'm definitely a bit disappointed with the speed of the device. It's fast, but it's not exactly flying. This is not due to the hardware, though; HTC's Sense UI is faster and more fluid on the new HTC HD Mini, which is based on 600 MHz CPU and Windows Mobile 6.5. However, as far as Androids go, HTC Desire is still on top of the food chain, partly due to HTC's Sense UI, which is getting better and more flexible with each new iteration.

Four months ago we asked you to vote in our Web Faceoff series for your preferred social network between the two current giants: Twitter versus Facebook. The results were pretty close, although Facebook edged out Twitter in a 48% to 40% victory. Now, there's a whole new game in town.

Google Buzz is now the new shiny, and represents Google's big push into social networking meets mobile social meets location services. We know it's still the early days for Buzz, but it seems like a good time to gauge the opinion of Mashable readers thus far.

Earlier, I posted a video asking which format you prefer our YouTube videos to be recorded in. Going a step further, I can't help but wonder what it is that will make the community one big happy bundle of joy. What do you want to see? What directions do envision our community taking?

For instance, if I post an article or video related to Apple, the Windows fans go ballistic. Likewise, whenever I posted something Windows-related, the Mac fanboys blow a gasket. It's like there's no happy medium these days. I cannot possibly make everyone happy all at once. I'm not even going to try!

As expected, HTC has unleashed a slew of Android smartphones here at the Mobile World Congress in Barcelona, and I have to admit they're looking really good.

While not exactly groundbreaking, HTC Desire is the top notch phone that competes primarily with Google's Nexus One (also made by HTC), as it has similar looks and pretty much the same specifications.

Here's a quick overview: it's an Android 2.1 phone with a 1 GHz Snapdragon CPU, 512MB or ROM and 576 MB of RAM memory, a 5 megapixel camera (with flash and autofocus), GPS, and the usual connectivity options: WiFi, Bluetooth, 3G. It also has a beautiful AMOLED 3.7 inch screen (multitouch is supported) with 480800 pixel resolution.

What makes it different from the Nexus One is the lack of trackball, and HTC's Sense UI, so the choice between the two will be strictly matter of personal preference. I will update this post with some hands-on experiences as soon as I lay my hands on it.

*Update: after trying out the HTC Desire I'm definitely a bit disappointed with the speed of the device. It's fast, but it's not exactly flying. This is not due to hardware, though; HTC's Sense UI is faster and more fluid on the new HTC HD Mini, which is based on 600 MHz CPU and Windows Mobile 6.5. However, as far as Androids go, HTC Desire is still on top of the food chain, partly due to HTC's Sense UI, which is getting better and more flexible with each new iteration.

- I had the best luck with FastPencil. In order to reduce the size of your exported blog, you'll first want to go to your comments section, click on the spam link and clear out any spam comments by selecting all the spam comments and clicking Empty Spam. Then you can export your WordPress blog (from the Dashboard, click Tools, then Export) as an XML file that you can download to your computer. From there, FastPencil lets you upload the .xml file and then select which blog posts to include in the book. You can also filter by time, which I had to do. Even my blog posts (no comments) from the last year and a half still made a 350+ page book, and FastPencil choked on turning my entire blog into a book.

FastPencil did a few things well. Included images were imported, and some formatting such as bold made it into the PDF. But other formatting, such as code formatting and newlines/spacing between paragraphs didn't make it. Embedded content such as videos or polls were likewise empty. Trying to import my entire blog also didn't work. But all in all, I was impressed with FastPencil. They also have nice collaboration tools (e.g. you can designate editors, reviewers, co-authors, and project managers to help in writing/polishing the content). The site also works through your web browser instead of as a downloadable program, which appealed to me. If you're used to WordPress, FastPencil won't be too much of a change.

It's still not a point-and-click affair to make a nice looking coffee table book out of a blog, but it's getting closer. Right now, the make a book niche feels like the early days of recordable CDs. Back then, CD-R discs were expensive enough that I would spend time to make sure that I used all the free space on the CD. Eventually prices dropped so much that you didn't feel bad about burning a half-empty or not-perfectly-polished CD.

With each new milestone in technological evolution we've seen a company emerge as the clear leader. In the current landscape, we observe this happening in several key parts of the marketplace including networking, search and operating systems.

Cloud computing is a new disruptive force that makes us ask the question whether we'll see the future of the cloud dominated by a single company. In this multi-part series, we'll take a look at a handful companies and envision what the world might look like, if, in fact, they win it all. We'll also analyze what it will take for a new company to rise up and claim the leadership role in this chapter of computing.

Dominance Happens: A Bit of Recent History

There has been a love/hate relationship with companies that dominate markets. On one hand, it's us consumers that make it happen. But when they become giants we cheer as governement regulators and competitors knock them down.

Microsoft has faced this issue perhaps more than any company in the past few decades. When the browser battles were in full swing in the late 1990s, Microsoft was taken to court by the Department of Justice for antitrust violations.

In this note released in 2000 - Technology, Market Changes, and Antitrust Enforcement -Microsoft evaluated the idea of whether it was consistent with public welfare for a company to "win" a technology market, and what it means to have a network effect in technology.

Microsoft makes the point that no technology company will hold a dominant position for long if it doesn't innovate and expand the market definition. Additionally, if a company doesn't find the right balance of trust and pricing between its customers new technologies will find a way into the market and cause customers to defect.

Point: A Dominant Vendor Will Emerge in the Cloud

Taking these factors into consideration, we believe there are several points that can support the argument that a dominant player in cloud computing in the future. Due to the nature of market forces a single vendor will emerge as the clear leader in offering cloud solutions.

  • First mover advantage: We're already seeing amazing things happen at first-movers like Amazon that are defining product and pricing. This gives them an advantage in fueling further growth and by learning and iterating the solutions in the market. Being first in an infrastructure-driven business will help them reach scale that others just can not reach easily - and potentially price it where others can't match.
  • Vendor lock: Once you get started with an infrastructure provider it becomes interwoven into business operations. By the current nature of the cloud (e.g. little standards, a lot of innovation) being first with leading solutions adds more momentum to the first-mover that wins strategic customers.
  • Strategic synergies: When we look at the combination of cloud computing and collaboration, we see a natural fit in services that meet more needs and take more market share. It may just work out that bundling works also in the cloud and creates the network effect that Microsoft is famous for. Cisco is also partnering across the landscape, with a focus on preparing the network for the cloud. By making it easier to manage your cloud with Cisco gear, it will provide IT leaders a reason to expand their relationships today, and stay tomorrow.
  • Acquisitions and Partnerships: Companies that buy their way into the market will be a big factor in putting momentum behind their offerings. Companies to watch: VMware, Cisco, Oracle. These companies are already showing that the race is on to win the cloud through aggregation of capabilities. Cisco has a blog dedicated to Cloud Computing, Oracle is going on tour sharing its ambitions for the cloud

Counterpoint: A Dominant Company Will Not Emerge in the Cloud

Perhaps no single organization will have the ability to create a dominant foundation in cloud computing. Instead, we'll see many types of solutions as equal peers in the market.

In a way, this runs against the grain of existing technology landscape and our history with successful innovations. Maybe that is why we love the idea of the cloud itself?

  • It's too big to own: One big reason to doubt a single dominant force in the cloud is that it feels like owning the Internet. Even Cisco with its strengths can't make such a claim. Perhaps the cloud is the perfect market, where the barriers of entry are low enough that continual evolution will occur.
  • It's a movement, not a layer: Another argument against the cloud having a dominant player is its fuzzy definition. There are many parts and pieces to it, and it's not clear today what it would mean to "win" the cloud computing market.
  • Portability will keep vendors in check: If customers demand solutions where they can move from vendor to vendor freely, it will impact the landscape. Companies with cloud solutions in the marketplace could be required by these customers to remove barriers to moving data and services between different entities. Additionally, standards and best practices may emerge that allow companies and individuals to move freely between providers. In this world, it will become a fluid market that prevents vendor lock and promotes pricing and trust as brand differentiators.

A Glimpse at Potential Futures

We've compiled a list of companies worth reviewing as candidates as possible dominant players in cloud computing. We'll be looking at their brand and the available assets that could be leveraged to achieve this position. Finally, we'll take a fresh look at what it might feel like if they succeed and shape the brave new world of cloud computing.

The list of candidates we're analyzing includes: Google, Microsoft, Apple, VMware, IBM, HP, Cisco, Amazon, Salesforce, Facebook, and our favorite, Insert new startup to our list by adding a comment below.

It has a 1GHz Qualcomm Snapdragon processor (which is the same CPU powering the Google Nexus One phone), and runs the Google Android operating system. But it's 4.8 inch display is larger than any screen you'll find on a cellphone anytime soon, making the Mini 5 much more attractive for surfing the web, watching video, or playing games. You can also make phone calls and surf the web over 3G or WiFi.

Final details on pricing, regional availability, wireless broadband partners, and a launch date aren't available yet. But Dell is showing off the Mini 5 tablet at Mobile World Congress in Spain this week, and letting a few details drop. Right now, for instance, the demo unit is running Android 1.6, but it's likely that by the time it's available to the public the tablet will sport a newer version of the OS, possibly 2.0, 2.1, or something even newer. Adobe Flash support is also on its way.

The Wall Street Journal reports that more changes are planned for Buzz in response to user feedback, including the option to block conversations and other filtering features.

Even as Buzz impressed some social media enthusiasts, it also angered some folks for various reasons the most significant being that it's a bit noisy and difficult to sort through, and that it isn't quite as privacy-friendly as everyone would have preferred.

The WSJ says Google assembled important company figures into a war room where they discussed ways to respond to user criticism. The first results were the big privacy tweaks that went live over the weekend an end to Reader and Picasa connectivity and Gmail contact auto-following. They also made it possible for users who aren't interested at all to remove the Buzz from Gmail completely.

The Wall Street Journal reports that more changes are planned for Buzz in response to user feedback, including the option to block conversations and other filtering features.

Even as Buzz impressed some social media enthusiasts, it also angered some folks for various reasons the most significant being that it's a bit noisy and difficult to sort through, and that it isn't quite as privacy-friendly as everyone would have preferred.

The WSJ says Google assembled important company figures into a war room where they discussed ways to respond to user criticism. The first results were the big privacy tweaks that went live over the weekend an end to Reader and Picasa connectivity and Gmail contact auto-following. They also made it possible for users who aren't interested at all to remove the Buzz from Gmail completely.

Founded by a 17 year-old Russian high school student named Andrew Ternovskiy, the service is a more successful Omegle, combining elements of the MTV show Next with vidchat capabilities.

Aspiring chatees click to play and as an escape latch you or your partner can hit Next anytime if you get bored, scared, or have to get back to work. The Report video as inappropriate button also seems to provide some comfort, but by judging by the nsfw fare served to me last night, doesn't provide much of a threat.

I pressed play last night at around 3:00 am PST and after about 45 clicks on Next encountered 5 straight up penis shots, a lot of camera disabled chats, two women who automatically clicked Next once they figured out that I too was a female, and a lot of very grateful looking guys, including a Chinese fan of Google and a French guy in indoor sunglasses, who asked me whether I was a more dominate lady or submissive woman in the hope that I would be the former.

Out of the 10,920 of my fellow Chatroulette participants, my Roulettees were a good cross section of Internet humanity. And while I did not encounter the suicide hanging videos alluded to in many of the chats, things like did you hear the one about the guy who shot himself in the bath tub, were brought up in conversation quite a few times, as examples of just how crazy Chatroulette can get.

Anywhere you get a mass of people communicating uncensored (and yes much like 4chan.org, China has not yet blocked Chatroulette) will be subject to typical groupthink behavior like urban myths and requests for interaction better left to the casual encounters section of Craigslist. Nonetheless, the service's potential for more substantial acts of communication is formidable.

Chatroulette is what you'd expect it to be, micro-interactive reality TV with a large heaping of cybersex. While most people are (whether they admit it or not) voyeurs the fact that Chatroulette lets the both participants see each other limits the site's potential user base to the weirdos and despite piquing VC Fred Wilson's interest it doesn't seem like there's currently enough weirdos to turn the humble startup into something mainstream.

One Roulettee, when asked what he thought the service was most useful for, responded, connecting with people around the world. Yeah, and asking them to show you their boobs.

But in this specific case, this actor has no business slamming Southwest when he knew he was too large for one seat. He purchased two seats for another flight but wanted to jump on a different flight that only had one seat available.
In accordance with Southwest's "customers of size" policy, Smith had purchased two tickets but then stood by for an earlier flight, which had one seat remaining. That is when the airline forced him off the plane.
This isn't discrimination at all. The only person being discriminated here would have been the passenger sitting next to Smith who paid full fair but had less space. It's true that most airlines have reduced the available space for passengers and at the same time, the size of Americans has increased.

If he already knew he needed to buy a second seat, his tantrum makes no sense. His twitpic attempt at humor noticeably avoids showing how he fit into his seat. For his neighbor on the flight, I doubt they would receive a discount due to the over sized passenger spilling into their already cramped space. Average sized people or small people don't receive any special benefits for taking up less space, do they? Even after Southwest apologized, Smith still blasted them. They'd be better off without this guy as a customer.

So what do you guys think?

I had to pull my left arm over to the right, with my elbow half way to my navel, the entire flight, so as not to be playing snugly with the guy to my left. It was very disconcerting, and physically uncomfortable, having someone else basically sharing your seat. I appreciate that we should not judge people by their weight. But I'm also not so sure that treating obesity as if it's a minority status is correct either. If your metabolism is screwed up, fine. If you eat too much crap, then I have less sympathy for you.

He lists six benefits that just don't compute under even light scrutiny:

1. The Answers market is in a land grab mode
Unlike eBay, where there's a general market for goods and you get huge network effects from having a critical mass of buyers and sellers, StackOverflow is all about niches. People who are searching for how to make sql server not go slow? aren't likely to bleed over to how to make swedish meatballs?.

This means that you'll have to fight for every niche. Similar to how general forums would have to fight for every niche. Just because you have a forum site that's big for gamers, you won't have much of an edge attracting foodies.

Finally, it's not like this is a new idea with no other entrants. Look at Yahoo Answers for a site that's still up with a similar model and look at Google Answers for another that couldn't be turned into a worthwhile business and closed.

2. Stack Overflow is like Starbucks
It really isn't. Starbucks can use capital efficiently because they have big capital expenditures securing land, building out stores, and purchasing coffee machines. Where's the capital intensity part of starting another answers site? Adding another server? Coming up with a new design?

It doesn't seem like Stack Overflow can efficiently use big money for anything but advertising itself. Which is kinda funny when the whole business is about getting page views to sell for ad crumbs. It also rings very much like dot-com. Remember when all you had to do was get eyeballs? Oh, it's free? Who cares, let's make it up on volume!

3. Stack Overflow wants to get on Techcrunch
If you're listing the publicity of Stack Overflow raises $10M in Series A by Fancy Schmancy VC as the 3rd pro for taking money, you're bound to be in trouble. The Techcrunch post you're going to get from this is going to scroll off the front page in 4 hours and nobody who's actually going to use your service is going to care.

Do you think people looking for an answer to how do I get the three gold rings in zelda? is going to give a hoot who's money you're burning to provide that forum? Or even that the advertisers you're hoping to attract is going to look at anything else than CPM and demographics for a clue on whether to invest? No.

4. The investor will give you advice, connections, and introductions
They may, but most of the introductions your typical investor is going to give you is how to get you out in 3-5 years. You can find a lot of advice in many places. Rarely is the quality of the advice associated with having money involved of largely superior quality.

And if you end up building something of considerable value, then the connections and introductions will come all by themselves. You usually have to work to fight them off with a stick when things are going great. And getting an intro to Mr. Very Important Person before you have anything of material value is usually not going to give you much anyway.

5. Taking money means big exit or IPO
I'd argue the opposite. When you take money, your exit is bound to be smaller unless you're playing the Web 2.0 lottery game (where a few lucky contestants gets bought for sums completely uncorrelated to business fundamentals). Taking money means giving up equity, which means there'll be less left over if you happen to build something that's valuable enough for others to buy.

And I don't know if you've heard, but the IPO markets aren't all that interested in eyeball companies without the numbers to back them up any more. Doesn't matter how many letters of the alphabet you've used for series whatever funding before you got there.

If you can build a great, profitable business, you'll have all the options to sell or go IPO. Taking VC only complicates that.

6. Taking VC will make your company successful
This one is funny. So if you're not looking to take VC and play the Web 2.0 lottery or aim for an early exit, you're just in it for personal aggrandizement. If you take the money, you just want the best for your business. Spot the disconnect here.

Now even given all this, there's actually still an argument for why Joel should take the money. It'll probably lower the chances of Stack Overflow ultimately succeeding as a long-term sustainable business, but if he has eyed that he has a hot property right now, it'll be a good time to take some money off the table.

A fool and his money will soon be departed applies equally to venture capitalists as it does to everyone else. If Joel and co. can negotiate a deal with Sand Hill road to give them a nice payout as part of the deal, this might well be even better than trying to shop around Stack Overflow for a sale that it's probably premature for.

Much better to take a small slice of the proceeds from a if this just get 1% of the billion dollar advertising market than to take the slice from how much money did you make for the past 12 months? of a strictly look-at-the-books sale.

Facebook users in the American West appear to move around a lot, and often have friends throughout the country, while users from Minnesota to Manhattan have connections much closer to home.

And in areas in and around Texas, on the edge of what's generally thought of as the Bible Belt, the Dallas Cowboys rank higher overall on users' fan pages than God.

These are just some of the interesting findings about Facebook users recently discovered by Pete Warden, a Colorado-based, British-born ex-Apple engineer who has spent the last six months gathering and analyzing data from more than 215 million public Facebook profile pages.

What he's discovered just might shed more light on the culture of connected America than the 2010 census.

"If you actually look at [Facebook user data] in the aggregate, it's like a painting," Warden told TechNewsDaily. "Each individual data point isn't interesting, but when you step back and look at the trends in millions of profiles, you start to see some pretty interesting pictures emerging."

Warden says he's been overwhelmed by the response he's gotten from this project, after working on similar projects in obscurity for years.

Among Warden's less surprising findings: Fox News host Glen Beck gets the number one spot on Facebook fan pages from users in Eastern Idaho. And the "Twilight" books, penned by Mormon author Stephenie Meyer, rank high in the heavily Mormon communities in and around Utah.

Facebook mining

These and other observations that Warden mined from the massive amount of Facebook data were posted on his blog last week, along with maps that break down the U.S. into seven regions based on Facebook user trends.

Now, after gathering the data from Facebook's site using software he designed and honed in the process, and making a first round of enticing observations, he wants to turn the raw data he's culled over to academia for further analysis. But he also hopes to steer investors and customers to his own software and services for further data gathering and aggregation.

"I'm much better at building the pipeline for processing the data than I am at doing really rigorous stuff with the results that come out at the end," Warden said in a telephone interview. "The patterns that I've blogged about in the U.S. data are very qualitative."

Indeed, much of the conclusions that Warden has drawn are open to interpretation, and his given names for America's regional social connection groups "Stayathomia" (the Northeast), "Socalistan" (Souther California), and "Mormonia" (the predominantly Mormon towns in Utah and Eastern Idaho) among them are playfully clever, but not very scientific.

Serious about privacy

But Warden is serious when it comes to people's privacy concerns, even though all the data being gathered is publicly available on Facebook's site, and can be found via Google. He says he wants to make the data useful for large-scale data analysis, but not for tracking down individuals.

"We want to make sure we don't help scammers, we don't help spammers, and we respect people's privacy," Warden said, "but also allow some sort of new insight to come out of this."

To that end, Warden has delayed releasing the data for the time being (he initially intended to release it yesterday, Feb. 9), after someone from Facebook contacted him, asking for some time to check the privacy implications.

Once Facebook clears the data for release to the academic world, Warden says he's ready to pass the task of interpreting all this data on to others and feature their conclusions on his blog more often than his own.

Meanwhile, Warden has some problems to patch in his data pipe, problems that have been helpfully pointed out by readers of his blog.

"One of the great things about getting this out there is having thousands of pairs of eyes to look over this stuff, like the fact that [the data shows] the top name in Alexandria, Louisiana is Mohamed," Warden said.

"When somebody pointed out that some of the profiles seemed to be coming from Alexandria, Egypt, that was a head-slapping moment."

We Americans like to think of ourselves as trendsetters for the rest of the globe, but when it comes to cell phones, we're still playing catch-up with countries such as Japan and Korea.

In general, Asians use their cell phones in more robust ways than the typical U.S. resident as TVs, wallets, GPS devices, and music players. Japanese cell phones can double as a house key, a credit card, and an ID. Users can even use their cell phones to send their vital signs straight to their doctors.

In recent years, U.S. companies have made baby steps toward incorporating more advanced cell phone features, particularly in the areas of mobile banking and video broadcast. Meantime, the Asian cell phone market continues to be a good predictor of features that could soon be included in American cell phones. For example, Japan had cameraenabled cell phones two years before Americans ever went gaga for them.

Curtis Schenck, a manager of corporate relations at NTT DoCoMo USA, gave TechNewsDaily the scoop on the hottest features in the Japanese market right now. Try not to be too jealous.

1. Personal Butler

Customers don't have to Google for information, since i-Concierge acts as their butlers or personal assistants and caters to their every need. Users can input their food preferences, neighborhoods they like, and entertainments that they enjoy. When new information is downloaded into the system, they get push notifications that are based on their preferences. For example, if they like Thai food and a new Thai restaurant that is opening nearby, their cell phones will notify them.

2. Investigative Visits

This takes the Verizon commercials to a whole new level. If a users' five-bar reception signal drops to three bars or if they have a dropped call, they can call customer service and a team will be sent out to investigate the problem.

3. Barcode Reader

Japanese phones can read QR marks, which are sophisticated barcodes for businesses. If an Asian cell phone user is walking down a Tokyo street and walks past a restaurant that isn't open, they can point their camera to the QR mark and their phone's browser will automatically be routed to the restaurant's Web site.

4. Free TV on the Phone

Subscribers can surf 13 free TV channels on their phones. DoCoMo has also launched their own channel called BTV to air programs that are filmed specifically for the mobile phone.

5. Phones as Payment Systems

Osaifu Keitai, also known as the mobile phone wallet, lets users load up credit card information onto their phones. If stores have a reader, users can swipe their phones over it to pay for their purchases. Cell phones can also be used to pay for subway and train tickets.

6. Send Money to Other Subscribers

Some Asian countries allow users to send money using their cell phones. Users simply input another person's phone number and the amount they owe them and like magic, the money is transferred.

7. Internal Wi-Fi Spot

Japanese cell phone users can download a movie onto their mobile phones and show it on their TVs. This is another way to get entertainment on demand. A femtocell base transceiver station (BTS) in the home hooks up mobile phones to the DoCoMo network through a broadband line such as an optical fiber. The femtocell BTS lets a person with a cell phone download videos and music files. Through femtocell BTS, a person can set up a private wireless network for their home appliances, entertainment systems, and other devices.

8. Home Security Service

Japanese cell phone users can lock their doors and manage their home security systems remotely using their mobile devices. They can also adjust appliances and set environmental controls, so their lights and heat can be switched on before they get home.

9. Environmental Awareness

DoCoMo has deployed environmental sensors throughout Japan and people are now able to monitor air quality, temperature, and UV rays around them using their cell phones.

10. Reads Vital Signs

In the same way that we might plug headphones into our iPhones, Japanese cell phone users can plug in equipment such as a blood pressure monitor to their phones and send vital signs directly to their doctors. This helps save some people a trip to the doctor.

Champagne Tastes on a Beer Budget?

While ViralHeat compares itself on price to services like Radian6, there is a primary difference between the two services. ViralHeat offers a full set of analytics features, from standard mention monitoring to sentiment analysis using a natural language algorithm, but this is where it stays. It does not venture over to the content creation side, where we find the more expensive and extensive services like Radian6. Other services might offer workflow management, scheduled content delivery and other conversational tools, but this would be overkill for the users we imagine at this app's usability sweetspot.

We see that as an additional merit: ViralHeat has both the price point and the feature set fit for the company that wants to get on top of its image and perception on the social Web but can't afford to bring a social media expert on board - and on salary. The learning curve is suitable for the DIY set and the analytics it provides are self explanatory, not riddled with indecipherable, industry jargon.

For those of you that like the pricing but want to do a little more with the data, the service also allows you to export data into Excel format and access your data using the API.

Speaking of pricing, this is a point that really brings it home for ViralHeat. To be fair, these two developments are really far apart in their delivery dates. The Gmail status update could come as soon as tomorrow, whereas the the speech-to-text-to-speech translation system is still a ways out. You can definitely see just how much work Google needs to do by trying to read your Google Voice voicemail transcriptions. (Voice search works better on Android 2.1 because you're talking slower and enunciating.) But both these features point in the same direction many of the company's other products have been hinting at. Here's a list of Google's major products, in case you forgot, and which sector of communication they want to dominate.

Google Voice: This is a big one, and it'll be the most natural interface for Google to slot in the voice-translation into. If you're using it the way Google wants you to use it, you're already piping all your voice calls and SMS through Google's tubes. And refining speech to text gives them a good idea of your interests and what you're talking about, allowing them to better serve up the relevant ads to you during calls.

Gmail: Having access to at least one end of everyone's email conversations, outside of business emails, gives Google the ability to be a gateway for most of your written communications. But that's not enough for Google, which is why they developed...

Google Wave: It's email, message boards, chat rooms and collaboration software all in one, except every participant needs a Google account. This closes that "openness" loophole that email has, and forces everyone into Google's biosphere. So this, and Gmail, should make sure that every medium-length communique passes through Google's maw for analysis. But what about shorter and longer forms? Update: Thanks commenters, for reminding me that Google made Wave open, so people can create their own Wave servers to talk to each other with the Wave protocol. The point still remains, that if you were going to use a service, wouldn't you rather use the service from the company that created the protocol, for performance and feature reasons?

Google Docs: For longer documents.

Google Talk: For short blasts of instant messaging, video chats and some audio chatting.

Picasa and YouTube: Communication doesn't have to be all text-based, you putting your photos and videos online count too.

Android and Chrome OS: By getting you down at the operating system level, Google can theoretically know every kind of communication you perform. It knows who you talk to, how you do it and when you do it. It can even shape the how by delivering the experience themselves.

Everything else. There's Checkout, Finance, Maps, Reader, News and other apps, which fill in the other forms of communication or expression that aren't quite covered by the major products above. One major missing piece is social networking, where Google basically failed before with its Orkut service (except for Brazil), so this new Twitter/Gmail hybrid might be their next entrance into the space.

But why do they want these things? Why would Google want to be the middleman between you and the world? To sell you ads, of course. And don't think Google is going to stop at just helping you talk over the internet or over the phone, they're going to reach into meatspace as well. How? One step is making that speech-to-speech translation portable, so you can do a sort of near-field communication with someone else with the same device while at the same time being able to look them in the face. Then, blast you two with the appropriate ads on the billboard next to you.

The full extent of the new features remain unclear, but Google is inviting reporters to a launch event Tuesday on its Mountain View, California, campus promising some innovations in two of our most popular products, according to an e-mail sent to reporters.

Yahoo has included similar features in its e-mail service, letting users see what photos their contacts have uploaded to Flickr, for example.

Google could integrate updates from a user's Twitter account, since most of that is public. And it could likely make it easy for Gmail users to post to Twitter as well, due to Twitter's liberal API policy.

Without fast, reliable Internet access and the funds to buy a decent computer, the Yellow Pages are a rational choice for business information. That's less the case in major cities, who've generally had access to 10+ years of high speed Internet access.

Here's what we've got:
  • It's based on Android 2.1. The build currently being circulated is identified as 2.1 version 1, mirroring the update just pushed to the Nexus One last week.
  • Google Goggles is now pre-installed (no matter how unhelpful it may be).
  • The browser's now multitouch enabled, just like Google Maps 3.4. Huzzah! No Flash, but then again, we weren't really expecting that.
  • Interestingly, the home screen's still got the same look as 2.0.1, meaning it doesn't adopt the Nexus One's rotating 3D grid of app icons -- it's still got the pull-up drawer tab at the bottom.
  • No active wallpapers. Bummer!
  • The news and weather widgets introduced on the Nexus One are included. Maybe certain capabilities of 2.1 are going to be restricted to devices with minimum performance benchmarks?
There's no word on timing, and for all our source knows, this build could still very well fail testing -- goodness knows it's happened with plenty of pre-production firmwares in Verizon's past. We'll keep our ear to the ground and you do the same.

The big project fails, the company begins to struggle and before you know it, the board of directors replaces the management team. Sound familiar? But crisis doesn't have to spell the end of the company itself.

Most companies and teams in turnaround situations focus on the obvious and important factors of balance sheet, cash flow and net income health. Teams also usually get to work quickly on market analysis that ultimately results in new product and business strategies. These actions are almost always necessary, just not always sufficient. Here are four often overlooked tactics that, if successfully employed, are critical to rapidly and successfully turning around a struggling enterprise:

1. Facilitate Closure - When a team has been through an extended period of hardship, it needs a sense of closure before it can start moving forward again, and closure is often best facilitated through a cathartic event that symbolizes the end of the perilous and painful journey. But while closure commonly necessitates letting a person or team go, don't rush to find a fall guy. Be very precise about identifying what was holding the company back it could just as easily have come in the form of an ineffective process or out-of-date strategy. Approach its removal the way you would a tumor: Excise carefully, and be wary of damaging any healthy surrounding tissue.

2. Set a Vision - According to intentional change theory, there are five steps to achieving sustained desired change. The first is to identify the ideal self, which for an organization is usually embodied in a collective vision consisting of its members' dreams (to be recognized as the best in the industry? world domination?), their desired future (market penetration? profitability?), and their strengths or values (high quality? extraordinary customer care?) Identify these in order to establish a shared vision that resonates with each team member on a deep, even emotional, level.

3. Find an Enemy - The easiest way to solidify an us is to identify a them. As Tajfel and Turner's social identity theory makes clear, people need to be part of a group, but in a company the result is often conflict between groups. The conflict that most often occurs in a crisis is affective and role-based and therefore often negative and value-destroying. There is no better way to rally the troops than to embody the fight with an external nemesis. Identify for your team an enemy outside the company and focus on beating or staying ahead of it, using everything from its press releases to its product launches to spur the team into action.

4. Tend the Garden - In our recently published book, The Art of Scalability, we talk at length about how leadership is like gardening. Leaders must hire or seed the team with the right people and mentor its members just as gardeners feed their plants. And when team members aren't working out, they need to be weeded out.

The time period between Microsoft's release of its XP desktop operating system and Vista marked the longest in the company's history between product launches. Jim Allchin, Microsoft's co-president, admitted in a Wall Street Journal interview to telling Bill Gates at one point that It's not going to work, describing the development as crashing to the ground due to haphazard methods of feature integration.

To recover from this, Microsoft enlisted the help of senior executive Amitabh Srivastava, who rooted out the process that was holding the project back. He then had a team of architects establish a development process that enforced high levels of code quality and reduced interdependencies. Once the new process was in place, the vision was set for what was ultimately a successful product launch, at least in terms of getting the product out the door and meeting the expected sales volumes.

There are entire books and domains of research dedicated to turning around failed projects and distressed teams. This list is in no way all-encompassing but if you are ever faced with the daunting task of turning around a team, these four tasks will be critical to its success.

The web is becoming more dynamic, context-aware and personalized by the day, and the amount of information consumed by each person is increasing exponentially. But while hardware performance is improving, except when it comes to the simplest of parallel programming tasks, software infrastructure is not keeping pace. We need to develop new data processing architectures ones that go beyond technologies like memcached, MapReduce, NoSQL, etc.

Think of this as a search problem. Traditionally, there was an index of every document in which every word occurred. When a query was received the search engine could just look up the precomputed answer to which documents had which word. For a personalized search, an exponentially larger index is needed that includes not only factual data (words in a document, brand of cameras, etc.) but also taste and preference data (people who like this camera tend to live in cities, be under 40, love Napoleon Dynamite, etc.).

Unfortunately, personalizing along 100 taste dimensions leads to nearly as many permutations of recommendation rankings as there are atoms in the universe! Obviously there isn't enough space to precompute what recommendations to show every possible type of person that queries a site. Additionally, precomputing the answer to queries is too slow. People expect real-time results, not hours- or days-old precomputed answers. If I tell Amazon I don't like a book, I want to immediately see that reflected in my recommendations.

We're at a turning point in how we need to build web sites to handle these sorts of personalization problems. While first-generation distributed systems split the application into three tiers web servers, application servers and databases second-generation systems build large non-real-time back-end clusters to analyze huge amounts of sales data, index billions of web documents etc.

A third generation of systems is now emerging, with the computation shifting from those back-end clusters into front-end real-time clusters. After all, you just can't build a back end that precomputes personalized results for millions of Internet users. You have to compute it in real time.

Adding complexity, many personalization problems are more difficult to parallelize than a lot of traditional back-end applications. Indexing the words in web pages is actually a lot easier to parallelize than are the long sequence of matrix calculations required to optimize a user's recommendations.
